Facility staff member #1 initially declined the Certification Representative's request for access to staff files that were not present at the facility during a complaint investigation. Age and Training (3270.31(e)(4)(i))

Upon inspection of personnel files, it was found that Staff Person #1 had an updated pediatric first aid and CPR certificate that lapsed between dates. The updated Pediatric first aid and CPR certificate had a date of 4/15/26 and previously expired on 3/31/26. Requirement: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Promote development (3270.111(c))

Toddlers were observed to be watching television and remained seated at the table with built-in seating totaling over 47 minutes, rather than freely exploring their environment or participating in a variety of activities during diaper-changing time. After being diapered, the children returned to sit until the staff member #2 completed the task. Two children became sleepy and rested their heads on the table before and after being diapered. Both were placed back at the table with built-in seating and fell asleep again. At the Certification Representative's request, facility staff member #1 provided appropriate rest equipment for the sleeping toddler. Requirement: 1. Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background. This portion of the plan shall have an immediate correction date. 2. The legal entity must arrange for all facility staff to receive a minimum of two hours of training and Technical Assistance (TA) to include at minimum: effective room arrangement, developmentally appropriate activities for children in care (including timeframes for use of equipment that restricts a child's movement and usage of screentime), and strategies for engaging children in learning. The operator shall provide a date of when this training will be completed. Correction: All children who are placed in the chairs during reading time or changing time must be moved at a certain time no longer than 15 minutes. Inspection: Unannounced Monitoring. Restraints prohibited (3270.113(e))

It was observed that young toddlers in the infant/toddler room spent a significant amount of time seated at the table with built-in seating, totaling over 47 minutes. The children remained seated during and after the morning snack, while watching an educational video, and during diaper-changing time. The chairs were used in a manner that limited and restricted their movement. Requirement: TIERED LIS: 1. A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. This portion of the plan shall have an immediate correction date. 2. The legal entity must arrange for all facility staff to receive a minimum of two hours of training and Technical Assistance (TA) to include at minimum: effective room arrangement, developmentally appropriate activities for children in care (including timeframes for use of equipment that restricts a child's movement and usage of screentime), and strategies for engaging children in learning. Observed an accumulation of packed snow and ice in the outdoor play space; the area is paved making it slippery and unsafe for large muscle activity due to creating a fall hazard. Requirement: Outdoor or indoor play space shall be safe for large muscle activity. Correction: The snow and ice were removed by adding shoveling and adding salt. Inspection: Unannounced Monitoring. Age appropriate (3270.101(a))

Observed the arts and craft shelves in the classroom lacked a sufficient number of materials for the children to use, paper was accessible to the children on the shelf without markers, crayons, and other art materials to meet the developmental needs, individual interests and ages of the children. The provider keeps art materials in a cabinet which is inaccessible to the children during free play times. Observed several toy shelves which were empty. Continued noncompliance previously cited on 10/28/2025. Requirement: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use. Observed a lunch box on top of the cubbies in the classroom which contained food items from the child's home which were not refrigerated including: pineapples, avocados and other perishable food items. Requirement: Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated. Plan reviewed/updated annually (3270.27(b))

The operator did not have documentation in writing of an annual review of the emergency plan. The emergency plan was last updated on 04/11/2024. Requirement: The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan and kept on file at the facility. The operator did not ensure staff person #5 received emergency plan training within 12 months of their initial emergency plan training; the most recent training was documented on 07/08/2024. Requirement: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. Observed Force of Nature Multipurpose cleaner on the changing table located in the infant/toddler classroom which was labeled "Keep out of reach of children" and was accessible to children. Requirement: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Correction: All cleaning material that has keep out of reach of children will be placed in supply closet away from children. Inspection: Renewal. Inaccessible to children (3270.75(b))

Observed a first-aid kit on the middle shelf of the changing table located in the infant/toddler classroom which was accessible to children. The first aid kit included: individual adult Tylenol packets, a tube of Neosporin ointment and a tube of Benadryl ointment. Requirement: A first-aid kit must be inaccessible to children. Correction: The first aid kits have been removed and replaced with the updated ones required by DHS. Building Surfaces (3270.76)

Observed a flat round drain grate approximately 6" in diameter in the outdoor play space, which was knocked loose from the drain it was covering. *Corrected at the time of the inspection. Observed a downspout which was loose against the side of the wall of the building next to the outdoor play space; the spout was hanging loosely and did not connect with the drainage pipe in the concrete. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Correction: The provider has made sure the drain gate was corrected. The larger rain pipe will be fixed on 11/17/2025 by the building contractor to assure it never gets lose again and is connected properly to ground for proper drainage. Inspection: Renewal. No peeling paint or plaster (3270.77(a))

Observed peeling paint on the exterior door frame of the door used to enter and exit into the outdoor play space. Requirement: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility. Toilet and sinks proper height (3270.82(e))

The portable sink in the large classroom used for handwashing next to the diaper changing table did not have a platform or steps for the younger and older toddlers to easy approach the sink. Staff were lifting the children up to help them wash their hands at the sink. Requirement: Toilets and sinks shall be at proper heights for children using them or shall be easily approached by means of platforms or steps. The waste receptacle next to the sink in the staff bathroom did not have a lid. Requirement: A toilet area, training chair area, diapering area and sink area shall be equipped with a clean, lidded waste receptacle. Stairs, exits, etc. unobstructed (3270.91(a))

Observed the back hallway leading to an exterior exit which was partially blocked by brooms and other objects leaning against the wall. *Corrected at the time of the inspection. Requirement: Stairways, hallways, exits from rooms, exits from the facility and other means of egress serving as an exit shall be unobstructed. The toddler area in the large classroom did not include a sufficient amount and variety of play equipment. The area had 3 foam vinyl climbing toys, a kitchen playset without toys, books 1 toy dump truck, 1 Sit & Spin, 1 xylophone a few toy cars, a few Duplo blocks and a Busy Box. The shelves were completely empty, and the toys available to not keep the 1 younger toddler and 4 older toddlers playing in the area engaged. The toys in the preschool and toddler areas of the large classroom were removed from the classroom for cleaning and were not replaced for the children to play with. Requirement: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use. Correction: The play equipment that was being washed and sanitized has now been placed back in its original location for the kids to use.
