Sec. 7-33(e), Ordinance: Direct supervision means watching and directing the childrens activities within close proximity within the same room inside or within a designated outdoor play area and responding to each childs needs. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [Child received scratches to the face]. Ratios/Discipline [SR] Comments: During the course of a complaint inspection, Video footage of alleged incident was requested and reviewed. The following was observed; Child A - Unknown child that caused the scratches Child B - The injured child Video stamp date is 3/17/2025 at 8:59AM. Three teachers were observed standing near the playground gate and the children are playing around the playground. The alleged incident is seen to have occurred behind the wooden play structure near the back of the playground. Child A is observed grabbing child B, by wrapping his arms from behind her. Child A drops his body back and both children fall back. At that point, both children are laying on the floor. Child B sits up and Child A throws himself on her, causing her to fall back to a laying position on the ground. At that point, children are seen gathering around, and one child goes to get a teacher. The teacher looks over and sees the commotion. At that point, she walks toward the children and tends to the child. The incident lasted about 40 seconds. A non-compliance for inadequate supervision is being issued. TA was provided regarding constant and direct supervision while on the playground. 08. 6.4(A), (B) and (D), Handbook: All accidents and incidents or unusual occurrences that are threatening to the health, safety, or welfare of a child that occur while the child is in care must be documented on the same day they occur. This documentation must be shared with the custodial parent or legal guardian on the date of occurrence. If the parent or legal guardian does not pick up the child on the date of occurrence of the accident or incident, the individual authorized to pick up the child must sign and be provided a copy of the accident/incident form. Documentation of an accident/incident was not provided on the day it occurred. Childrens Records [SR] Comments: Complaint alleges that child (girl) had an incident at the school and an incident report nor a call was made to the parents on the day of the incident. School is refusing to show footage of incident to the parents. FINDINGS: A complaint inspection was initiated on 3/20/2025 and completed on 3/21/2025. Per the director, the incident happened on the playground on Monday, 3/17/2025. That morning, there were 3 teachers on the playground so there were enough staff to cover ratio until the rest of the teachers arrived at 9am. After the incident, there were several events that happened that kept her occupied and she could not call the parents. The accident report was issued in the morning on 3/18/2025. This complaint is substantiated as an accident /incident report was not issued on the date of occurrence. TA was provided on report documentation on date of occurrence. 41. Sec. 7-32, Ordinance: Before the first day of employment at a child care facility, all child care personnel, excluding temporary substitutes, must have on file at the child care facility a signed statement from a licensed physician or authorized agent of the Florida Department of Health attesting that the person is in good health in order to care for children in a child care facility setting. The health assessment statement shall be documented on a form prescribed by the local licensing agency and updated at least every two years. Child Care personnel did not have a current health statement on file. Comments: 4 staff members were found with expired physicals. see notes 06. 3.12(C), Handbook: All equipment, fences, and objects on the facilitys premises shall be free from sharp, broken and jagged edges, and properly placed to prevent overcrowding or safety hazards in any one area. Equipment in the outdoor space needs repair. (Section 2.1(A) Health and Safety, Page 3) Indoor/Outdoor Space [SR] Comments: The back wooden gate needs to be repaired as it was not secure and 7 wooden planks would need to be repaired in addition to repairing some boards on a climber.
