3.12(D)(1) and (2), Handbook: Permanent or stationary playground equipment must have a fall/use zone that extends a minimum of 6 feet in all directions from the perimeter of the equipment. If the ground cover in place is loose ground cover (such as, but not limited to: mulch, shredded rubber chips, or sand) a minimum of 6 inches in depth is required in the use zone. Asphalt, concrete, hard packed dirt, hay, grass or leaves are unsuitable for use in the use zone area. If the ground cover in place is a unitary playground surface, then the unitary surfacing materials must be installed, maintained, or replaced according to manufacturers instructions. Unitary surfaces must be tested to and comply with ASTM F1292; documentation of test data must be retained at the facility and available for licensing to review. The playground surface was insufficient. 3.12(C), Handbook: All equipment, fences, and objects on the facilitys premises shall be free from sharp, broken and jagged edges, and properly placed to prevent overcrowding or safety hazards in any one area. 2.4.4(B), Handbook: Children must not be left in high chairs or other types of feeding chairs other than feeding times. A child was observed in a high chair outside of feeding times. Food Service/Nutrition [SR] Comments: Complaint alleges that child (MM DOB: 2/3/2022) was observed in a high chair at pickup time on two occasions, 11/15/2024 and 11/18/2024. A complaint inspection was conducted and statement from the Owner was received: Statements: Per owner, she was the one that put her on the high chair while on the playground because the child climbs the fence, she runs and she has to run behind her to stop her. On Monday, they went out to the playground around 4:30 or a little earlier and parent picks up after 5pm.On Friday, the child was spitting and hitting Ms. Crawford. Ms. Crawford put her on the high chair and put her next to her so she doesn't hit and kick other children. Findings: Complaint is Substantiated as the child was placed in a high chair during non-feeding time. 35. Per owner, she is always here and and she does not recall the mother mentioning anything to her about the bruise on the lip. The parent did not mention it to her nor to the director.
