SECOND CITATION; PREVIOUSLY CITED ON 12/18/25: According to staff statements and video camera footage, on 1/6/26 at approximately 1:15 PM in the Zebra room, Facility Person #1 was observed aggressively picking up Child #1 and dropping them on their rest mat face down twice. They then abruptly dragged the child's mat to another part of the room, causing the child to almost fall from the mat. The staff person then took the child and their mat to the Rhinos room where they roughly sat the child on the mat where the child remained for a few minutes before Facility Person #1 returned the child to the care of another staff person in the Zebra room. Requirement: 1.A facility person may not use any form of physical punishment, including spanking a child. THIS PORTION OF THE PLAN SHALL HAVE AN IMMEDIATE CORRECTION DATE. 2. The legal entity shall ensure that all facility staff persons complete a training regarding appropriate behavior guidance of children. Prior to registering for the training, the operator shall send the training title/description to the certification representative for approval. Documentation of the training, as required under Chapter 3270.192, shall be retained on file and forwarded to the certification representative. THE OPERATOR SHALL PROVIDE A DATE FOR WHEN THIS WILL BE COMPLETED 3. The legal entity shall ensure that all facility staff persons complete a training regarding stress management. Prior to registering for the training, the operator shall send the training title/description to the certification representative for approval. Documentation of the training, as required under Chapter 3270.192, shall be retained on file and forwarded to the certification representative. THE OPERATOR SHALL PROVIDE A DATE FOR WHEN THIS WILL BE COMPLETED 4. After completion of the required trainings, the operator shall conduct a staff meeting, with all facility staff in attendance, to discuss the facility's policies on behavior guidance, the trainings and their content, and offer staff the opportunity to ask questions and receive feedback regarding the policies and trainings and apply them to their experiences in the classroom. The meeting date, attendees and agenda shall be documented, retained on file, and forwarded to the certification representative. THE OPERATOR SHALL PROVIDE A DATE FOR WHEN THIS WILL BE COMPLETED Correction: 1/13/2026- No staff in the facility will use any form of physical punishment, including spanking a child. 4/30/2026-All staff will receive training regarding appropriate behavior guidance of children. Restraints prohibited (3270.113(e))

According to staff statements and video camera footage, on 1/6/26 at approximately 1:15 PM in the Zebra room, Facility Person #1 was observed holding Child #1 down on their rest mat with one hand on the child's legs, and the other on their torso. Requirement: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Correction: No facility person shall restrain a child. No physical punishment (3270.113(b))

As observed on classroom video footage, on 12/3/25, at approximately 12:15 PM in the Grasshoppers Room, Facility Person #1 abruptly lifted up Child #1 from the floor, positioned the child on their hip, then aggressively put the child down into a chair and pushed the chair towards a table. Child #1 then pushed away a cup that was on the table in front of them, and Facility Person #1 then leaned over the back of the child and covered the child's mouth with their hand. The interaction between the staff and child ended when the child's parent, who had just entered the room, approached the child. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Facility Person #1 was given a 3-day suspension. Facility Person #1 was also placed on a 30-day probationary period in which they are not allowed to be alone in ratio with any children. They were told to be more mindful of their physical actions with the children and to call for help if any situations become too stressful. Any incident within this 30-day period would result in immediate termination. Supervised at all times (3270.113(a))

The operator reported an incident occurring on 6/20/25. At approximately 11:00, the facility conducted a lockdown drill. During the drill, Facility Persons #1 and #2 were supervising a group of children in a staff restroom with the lights off. According to staff statements, Child #1 stated they were touched inappropriately by another unknown child while the lights were off. Staff state they were unable to see the children during this time to determine what occurred. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Correction: Small battery-operated lights have been installed in the bathrooms so that the children can be supervised while conducting lockdown drills. Inspection: Complaints- Legal Location.
