23. Swimming Pool Group: DCF Handbook (23-02)

2.4.5(C), Handbook: The following minimum staff-to-child ratios must apply while children are swimming or wading: Infant (Birth up to 1 year) 1:1, Toddler (1 year up to 3 years) 1:1, Preschooler (3 years up to 5 years) 1:4, School-Age Children (5 years and up) 1:10, Mixed Age Groups Ratio shall be based on age of the youngest child present. A staff-to-child ratio of [1] staff for [13] children was observed during a water activity. Indoor/Outdoor Space [SR] Comments: A complaint investigation was initiated by QAS team Q. Gomez and D. Williams on 7/2/2026 and a statement from the director was received. Complaint investigation was concluded on 7/6/2026. Complaint inspection report and Notice of violation was completed and given to the provider on 7/7/2026. Per the director, they offer water day on Tuesdays and Thursdays for preschool aged children. Water days are offered on Monday, Wednesday and Fridays for the older children. Upon arrival, we requested to see the outdoor play area and we observed children playing. There were four 1 y/o children with 2 teachers playing in a splashpad and 26 school aged children playing in the same field with four staff members. We also observed seven 2 y/o children playing in the enclosed playground with one teacher. We observed the pool area and asked if there are cameras in that area to which the director stated yes. I asked if we could see Tuesday and Thursday, 6/23/2026 and 6/25/2026, and the director agreed to show us. A Pool Day sign was observed inside the facility and the director stated that they have only used the pool once. The CCTV footage from June 23, 2026 was reviewed, and it confirms that the children did not go to the pool on this date, as previously stated by the director. The CCTV footage from June 25, 2026 was reviewed, and it confirms that the children did go to the pool. Between 9:39AM, the director was in the pool with her 9 y/o child and 1 toddler (D. Simeon). The child then left with a teacher (Ms. M.) at 9:45AM. At 9:48AM, four 1 y/o children were observed walking to the pool with teacher (Ms. V.). The four 1 y/o children were in the pool with the director until 9:53AM when the assistant director, Ms. J. entered the pool to assist but did not enter the water. By 9:59AM, the 1y/o children were observed leaving the pool with Ms. V. Between 10:05AM - 10:09AM, nine 2 y/o children, one 3 y/o child and the directors 9y/o child were observed in the pool with the director. The teacher (Ms. D.) was observed entering the pool at 10:07AM. Ms. J was observed cleaning the pool at this time until 10:07AM. Between 10:09AM - 10:21AM, three 3 y/o children came to the pool with their teacher (Ms. W.). At that time, there were 13 children ranging from ages two to three and the directors 9 y/o child in the pool with the director, Ms. D. and Ms. W. in the pool. The teachers (Ms. D. and W.) were observed in the pool with the children. A copy of 6/25/2026 attendance sheets were received. The schools Health Department pool inspection was reviewed and the inspector determined that the pool was closed and a re-inspection was required prior to using the pool. Technical assistance was provided that the pool must close until that approval is received from the Health Department and all CCLE pool requirements are met. This complaint is deemed substantiated and a Class 1 Notice of Violation and fine are being issued for water activity ratios. TOILET/BATH FACILITY 24. 2.4.5(A), Handbook: If a facility uses a swimming pool on site or during a field trip that is more than three feet deep or uses beach or lake areas for water activities, there must be at least one certified lifeguard present and on duty. If the lifeguard is hired by the facility, this person is considered child care personnel and can also serve as the additional adult to meet the requirement in 2.4.1(G). There was no one with the required training present when children were at the [on-site pool]. Indoor/Outdoor Space [SR] Comments: During the course of a complaint investigation on 7/2/2026, the following non-compliance was observed on CCTV footage: On 6/25/2026, the school used the pool with children ages one to three without a lifeguard present and on duty. When asked, the director confirmed that she is not a certified lifeguard, stating that she had completed prior training but is not a lifeguard. 3.5(F), Handbook: The outdoor play area must have adequate fencing or walls a minimum of 4 feet in height. Fencing, including gates, must be continuous and must not have gaps or opening larger than 3 inches that would allow children to exit the outdoor play area. The base of the fence must remain at ground level, and be free from erosion or build-up to prevent inside and outside access by children or animals. These areas must have at least two exits, with at least one being remote from the buildings. If an outdoor play area was approved for usage by the Department prior to October 25, 2017, no new exits are required to be added to meet this standard. However, if outdoor play area fencing is changed then the standard would apply and two exits must be provided. The facilitys fencing was inadequate in that [see details below]. (Section 2.1(A) Health and Safety, Page 3) Indoor/Outdoor Space [SR] Comments: At the time of inspection the licensing monitor observed the facility fencing was inadequate in that the base of the playground fence was not at ground level and allowed access for children to exit. Reptiles shall not be handled by children. 3.1(C), Handbook: Animals that are poisonous, venomous, aggressive, or pose a potential threat of harm to children in care are prohibited. No animal may freely roam the indoor/outdoor premises. Animals are prohibited in areas where food is prepared, stored, or served. If animals or birds are kept in classrooms, they shall be caged and cages must be kept clean. This area was out of compliance in that [see below]. Sec 7-30(a)(3), Ordinance: All child care personnel who provide care to infants at child care facilities shall, prior to caring for such infants, successfully complete the most current training course approved by the local licensing agency relating to providing an infant safe sleep environment, as identified on the local licensing agencys website. The owner of a child care facility must ensure that all such child care personnel are in compliance with the training requirements of this section, and that such training is renewed every 2 years, in the same manner as provided for the initial training. Successful completion of the required training must be evidenced by a certificate, or any equivalent documentation, issued by the applicable training organization in the name of the individual who completed the course and indicating the date the course was completed. Documentation evidencing compliance with the training requirements under this section shall be included in the individual's personnel file maintained at the child care facility. 3.8.5(A) and (B), Handbook: The operator must develop a written emergency preparedness plan that includes, at a minimum, procedures to be taken by the facility during a fire, evacuation, relocation, shelter in place, lockdown, and inclement weather (for example: hurricanes, tropical storms or tornadoes), and to facilitate parent/guardian reunification onsite and offsite. Lockdown and inclement weather drills shall be conducted a minimum of one time each per operating year when children are in care and the documentation of these drills must be maintained for 12 months from the date of the drill. A lockdown or inclement weather drill may substitute for one monthly fire drill. Substitutions for fire drills may not occur more than three times within the licensure year. Documentation of this substitution must be maintained for 12 months from the date of the drill. The facility failed to conduct emergency preparedness drills as required.
