2.8(A-B), and (F)(1-9), Handbook: The child care facility shall adopt a discipline policy consistent with Section 402.305(12), F.S., including standards that prohibit children from being subjected to discipline which is severe, humiliating, frightening, or associated with food, rest, or toileting. Spanking or any other form of physical punishment is prohibited. The child care facility operators, employees, and volunteers must comply with written disciplinary and expulsion policies. The following discipline techniques shall be prohibited in the child care facility: the use of corporal punishment/including, but not limited to: hitting, spanking, shaking, slapping, twisting, pulling, squeezing, or biting; demanding excessive physical exercise, excessive rest, or strenuous or bizarre postures; compelling a child to eat or have in his/her mouth soap, food, spices, or foreign substances; exposing a child to extremes temperature; rough or harsh handling of children, including but not limited to: lifting or jerking by one or both arms; pushing; forcing or restricting movement; lifting or moving by grasping clothing; covering a childs head; isolating a child in an adjacent room, hallway, closet, darkened area, play area, or any other area where the child cannot be seen or supervised; binding, tying or restrict movement, or taping the mouth; using or withholding food or beverages as a punishment; toilet learning/training methods that punish, demean, or humiliate a child; any form of emotional abuse, including rejecting, terrorizing, extended ignoring, isolating, or corrupting a child; any abuse or maltreatment of a child; abusive, profane, or sarcastic language or verbal abuse, threats, or derogatory remarks in front of the child or about the child or childs family; placing a child in a crib/portable crib for a time-out or for disciplinary reasons. A method of discipline was used that was inappropriate in that [see details below]. Comments: Facility self-reported with a video to verify complaint alleges that a child was picked up by the back of the shirt and pushed onto the floor by the arm and up against the wall. Video shows child care personnel being rough and throwing a book. FINDINGS: On Wednesday, May 13, 2026 the program director contacted CCLE to report child care personnel (C.W) was observed using an inappropriate method of discipline. As a result, the child received welts on the back of the neck. The licensing monitor viewed video footage of C.W aggressively grabbing the child and forcefully handling them, shoving the child into the corner of the classroom, and pushing the child against the wall. The video also showed C.W snatching a book and toys from the children and throwing the items collected in the opposite corner. The program director stated C.W was immediately terminated as of 5/13/26 and discipline/appropriate practice training will be conducted for all staff. This complaint is substantiated for inappropriate method of discipline was observed through video footage during todays complaint inspection. 4.1, Handbook: Child care personnel including volunteers who work 10 hours or more per month must successfully complete the departments training within 12 months from the date training begins. Training completion may not exceed 15 months from the date of employment in the child care industry in any licensed Florida child care facility. The facility did not have documentation of child care personnel's completion of required training on the training transcript in that [see below]. Sec. 7-45(b)(2), Ordinance: All trash, debris, and dirt must be removed from the vehicles daily. All seats, safety restraint devices, and fixtures must be maintained free of rips and tears and in good repair at all times. Vehicles must be cleaned and sanitized routinely. Sec. 7-45(b)(1), Ordinance: Vehicles must state the name of the child care facility on each side panel in six- to eight-inch letters. The back panel must have the wording Caution Transporting Children in a minimum of four-inch letters. The facilitys license number also must be printed on the side and back panels of the vehicle.
