R381-100-11(1)(a)-(g) — Provide and maintain active supervision

The Licensee was out of compliance with R381-100-11(1)(e) by failing to ensure all children received active supervision. During the inspection, the licensor identified that a child was left unsupervised in their classroom, when the other students went to the playground, when their teacher did not know the number of children in their care and account for every child. This is a repeat rule non-compliance. Inspection: Focus Inspection. Repeat noncompliance. Civil money penalty: $200. Correction status: Correction Verified. Correction action: On June 24, 2025, the licensor verified that the provider re-trained all staff on active supervision to ensure every child received active supervision, and that staff knew the number of children in their care, at all times, as required in rule.

R381-100-12(5)(a)-(f) — Interactions with children

The Licensee was out of compliance with R381-100-12(5)(a) for failing to ensure that interactions with the children do not include any form of corporal punishment or any action that produces physical pain or discomfort. During an investigation, the investigator identified that a caregiver kicked the chair of a child causing the child to slide away from the table they were sitting at. Correction action: On June 24, 2025, the licensor verified that the provider re-trained staff on interactions with children to ensure they did not include any form of corporal punishment, as required in rule.

R381-100-17(3)(a)-(d) — Medication container requirements

The provider was out of compliance with this rule by not ensuring a prescription medication was stored in the original pharmacy container. In the facility, there was an epi pen with no original pharmacy container. This was a repeat rule noncompliance. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On 12/4/2024, the licensor verified the provider meets the medication container requirements through an email the provider sent with the prescription label for the epi pen and that it is stored with the medication as stated in rule.

The provider was out of compliance with this rule by not ensuring that choking hazards are inaccessible to children younger than three years old. In the Discovery B room, there were plastic toys that fit inside a choke tube. This was a repeat rule noncompliance. Inspection: Unannounced, Annual Inspection.
