There were no criminal history or sex offender clearance on file for Facility Person #1 from a state in which they resided in the previous 5 years. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility without all required current completed clearances on file. Correction: Person #1 was asked to leave until her clearance was received. We had already applied for the clearance. Infant sleep position (3270.119)

The following was observed on video footage provided by the operator recorded on 3/10/26 at 3:35pm: In the infant room, one infant wearing a blue bib was sitting in a motion swing, making small arm and leg movements within the first few seconds of footage. As of 3:36pm onward, the infant appears to have fallen asleep in the swing, as evidenced by lack of movement of the infant's head, arms, and legs. The infant remains asleep in the swing for approximately 23 minutes until approximately 3:59pm, when arm movement is observed. The infant does not have a documented medical reason why they should not sleep in the recommended sleeping position by the American Academy of Pediatrics. Requirement: TIERED IS: 1.) Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility. The portion of the plan shall have an immediate correction date. 2.) The director, assistant director, and representative(s) from executive leadership will participate in a virtual technical assistance session with the senior health management staff at PA Key to conduct a Root Cause Analysis to determine "next steps" for improving systemic issues regarding supervision and risk management. Discussions can include, but are not limited to, the topics of: active supervision, classroom management, anticipating children's movements, response to child injuries, and creating a safe environment for caring for infants. Prior to attending the TA meeting, the director, assistant director, and representative(s) from executive leadership will be required to watch the video of the incident from 3/10/26 and come to the meeting prepared to discuss. The correction date for this portion of the plan will be based on when this technical assistance training is to be scheduled. Correction: 1.) 3/10/26 All employees will ensure that infants are placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. General Health and Safety (3270.21)

During a complaint investigation conducted on 3/24/26, based on information obtained during staff interviews, it was determined that on 3/3/26 an infant had been placed in their crib for a nap, a bib was observed around the infant's neck underneath their sleep sack. Requirement: TIERED LIS: 1.) Conditions at the facility may not pose a threat to the health or safety of the children. The portion of the plan shall have an immediate correction date. 2.) Director, Assistant Director, and all staff shall complete the following Better Kid Care training titled 'Reduce the Risk of SUID Through Safe Sleep Practices'. Proof of training will be submitted to the OCDEL Western Region Certification Rep upon completion and may be counted towards annual training hours. The operator shall provide a date for when this training will be completed. Correction: 1.) 3/3/26: Effective immediately, staff were instructed to ensure that conditions at the facility may not pose a threat to the health of safety of the children. [Implemented 3/3/26] 2.) 6/1/26: The Director, Assistant Director, and all staff will complete the following better kid care training titled "Reduce the Risk of SUID Through Safe Sleep Practices". Building Surfaces (3270.76)

In the PreK Room and the Preschool 2 Room, one ceiling tile near the video surveillance camera was observed to not be kept clean as evidence by having water damage spots due to a leak from the roof. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Correction: To correct our noncompliance, our maintenance company came in and took out the dirty ceiling tile and replaced with new ones. Inspection: Renewal. Health information (3270.131(a))

The child file for Child #4, who is an older toddler, was observed to lack a valid health report within 60 days following the first day of attendance at the facility. Requirement: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. Correction: To correct this regulation, health assessments will be provided within 60 days of each child's start date. Child #4 has a valid health report on file. Inspection: Renewal. Availability of certificate of compliance and applicable regulations (3270.25(a))

The facility's current certificate of compliance was observed not to be posted in a conspicuous location used by parents. Requirement: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional childcare office. Original label (3270.133(5))

In the PreK Room, an epi pen for Child #5 was observed to have expired as of 12/2025. Requirement: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label. Correction: The Epi-Pen was sent home with the family. Toddler/preschool: updated health report every 12 months (3270.131(b)(2))

The child file for Child #3, who is a preschool age child, was observed to contain an updated health report dated 2/4/26 which was conducted more than 12 months from the previously dated 1/28/25 health report on file. Requirement: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child. Correction: To correct the noncompliance, the parents will provide a health report within 12 months. For each well visit the family will bring us an updated form. Inspection: Renewal. Each child care space (3270.124(c))

In the Infant Room, an emergency contact form was not present for Child #6 who was receiving care in the room. Requirement: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space. Correction: The emergency contact form was provided at the time of the inspection. It was located in the office, and just not handed to the teacher yet. The child had just started the day before. Services proceeded (3270.123(a)(3))

The child file for Child #1 and Child #2 contained a current child service report that was dated Dec. 2025, and the previous report was observed to lack a date; therefore, it was unable to be determined if the child service reports were completed within six months of each other. Requirement: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). Correction: The service reports were from June of 2025. To fix our noncompliance, we will have the parents sign off on the time frame in which it was presented to them. Inspection: Renewal. Supervised at all times (3270.113(a))

At approximately 1:45pm, during naptime in the Preschool Readiness Room where Staff #2 was positioned in the room they could not adequately supervise one of the napping children due to a child's table and chairs obstructing Staff #2's ability to see and assess that child who was napping. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Correction: To correct this supervision issue, the teacher moved the child's table and chairs under the cubbies and placed herself by the door looking into the room, on the other side of the table and chairs to be sure nothing was obstructing her view of each child. Locked or inaccessible (3270.66(a))

In the PreK Room, a bottle of hand sanitizer was observed on top of the writing desk and accessible to the preschool age children in care. Requirement: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Correction: To correct our noncompliance, the hand sanitizer was moved to the locked teacher cabinet, where the children cannot access it. Inspection: Renewal. Protective Outlet Covers 5 yrs. or less (3270.65)

In the Preschool 2 Room, an electrical outlet located to the left of a child's reading chair, and accessible to children 5 years of age or younger, was observed to lack one protective cover. Requirement: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger. Mixed Age Level/Toddler and preschool children (3270.52/3270.55(a))

In the Toddler 2 Room, at approximately 1:50pm, one staff and eleven young toddlers and older toddlers were observed. Therefore, Staff #7 exceeded the child: staff naptime ratio by one child. Requirement: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). The staff:child ratio while toddlers and preschoolers are napping is one staff person to 10 young toddlers, one staff person to 12 older toddlers, one staff person to 20 preschool children. Correction: To fix our noncompliance - the toddler 2 room will nap 10 children, when a mixed ratio of 1 and 2 year old's occur. The staff file for Staff person #4 and Staff person #5, who are functioning as an Assistant Group Supervisor, lacked proof of education. Requirement: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility. Correction: To correct the files for staff person #4 and #5, their transcripts will be provided from their colleges/universities. Inspection: Renewal. Fire safety - 1 yr. (3270.31(e)(4)(ii))

The staff file for Staff person #3 was observed to contain fire safety trainings that were conducted more than 12 months apart; those fire safety trainings are dated 10/7/25 and 8/9/24. Requirement: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent. Age and Training (3270.31(e)(4)(i))

The staff file for Staff person #6 contained current pediatric first aid/CPR training dated October 2025 which was not renewed on or before the expiration of the previous training certificate on file dated August 2023. Requirement: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. Correction: Staff will receive their updated CPR/1st Aid training within 2 years, based off of of their previous training. Inspection: Renewal. The facility's emergency plan was observed not to be posted in a conspicuous location. Requirement: The operator shall post the emergency plan in the facility at a conspicuous location. Correction: A note was posted in the entry way, stating that if you would like to review our Emergency Plan, it is located in the office. Outdoor equip.- protective surfacing (3270.102(c))

The facility's documentation regarding the poured playground surfacing lacked the fall height rating that is necessary to determine if the surfacing meets the required shock absorption for a fall from the highest point of the embedded play equipment. Requirement: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair. Correction: To correct the information needed on the poured playground surface fall height rating, we contacted the company who installed our playground. They created a new letter that includes the fall height rating that correspond with our playground surface. It meets an acceptable fall height of 6 feet. Inspection: Initial review. Devices must be compliant/Director or designated staff person ensure compliance (3270.95(a)/3270.95(b))

The facility's documentation regarding the testing of their fire detection system by a fire safety professional was deemed unacceptable as it did not include the results of the testing. Requirement: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met. Correction: Our documentation regarding the testing of our fire detection system was re-evaluated by our Fire Marshal.
