Based on interviews, it was determined that Staff Person #1 grabbed a child's arm, in a jerking motion and pulled the child toward him/her and Staff Person #1 grabbed a child by both arms and forcefully pushed the child backwards. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Staff person #1 was terminated immediately on 4/4/25. Training regarding plan (3270.27(c))

The current emergency plan training documented and on file for Facility Person #6 was completed more than 12 months after the previously documented emergency plan training. Requirement: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent. There was peeling paint/damaged plaster in the following locations: in Preschool 1 on the wall in the corner near where the cots are stored, in the Schoolage room on a wall near the restroom, and in the Transition room on the wall behind the high chairs. Requirement: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility. 2 hour diaper check (3270.135(e))

In the Older Toddler room, diaper changing records for 11/3/25 were reviewed. Records indicated that several children were diapered at 11:30 AM and then again at 2:30 PM. Staff stated that the children's diapers were not checked or changed in between these times as they had a snack after naptime and were checked/changed after their snack time. Requirement: A staff person shall check a child's diaper at least every 2 hours and whenever the child indicates discomfort or exhibits behavior that suggests a soiled diaper. A staff person shall change a child's diaper when the diaper is soiled. Correction: We spoke with all teachers in all classrooms and explained that a staff person must check a child's diaper at least every two hours, therefore must have a diaper change immediately after nap then they can serve snack. Supervised at all times (3270.113(a))

According to statements from staff, staff persons have been observed not supervising children appropriately while in the outdoor playspace. Staff state they have observed other staff on their phones or standing in a group talking to each other, rather than paying attention to the children. Staff also state that at times they have seen children on the playground unable to be seen by the staff supervising them, as the only staff with the group is either in a seated stationary position or standing near the fence talking to others on the other side of the fence, and there is equipment blocking the view of a portion of the playground. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Correction: Cell phones are not allowed for anything in the classrooms. Each classroom now has an iPad for Procare use and communication between classrooms. We have reviewed our active supervision policies with all staff and assigned places to stand on the playground to ensure clear visibility of children during outside play time. Based on interviews it was determined that Staff Person #1 used harsh, demeaning or abusive language in the presence of children. Staff Person #1 completed Pediatric First Aid/Pediatric CPR training; however, the First Aid/CPR card did not include the word "Pediatric" in the "Optional Modules Completed" section of the card. (See LIS Code Sheet) Requirement: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. During the complaint investigation and while reviewing staff files, it was determined that Staff Person #2, who resided in New York State within the past five (5) years, lacked the required out-of-state clearances. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #2-- may not work in a childcare position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #2--- may not work in a childcare position at the facility. Correction: Staff Person #2 was put on leave until we received her NYS clearances. Promote development (3270.111(c))

During a complaint investigation, and based on staff interviews, it was determined that in the Young Toddler Room, the childcare facility did not provide daily activities that promoted the development of skills, social competence, and self-esteem for a younger toddler. Requirement: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background. Correction: We immediately terminated the employee who was not promoting a positive environment for the children in the young toddler room as soon as we were made aware of the situation in April 2025. According to staff statements, there are occasions when children are dropped off at the center by parents in the morning, and the additional child or children put the particular group out of ratio when the parents leave the classroom. The group remains out of a ratio for a few minutes while classroom staff alert center administration and until staffing is adjusted. Requirement: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan. Correction: Our letter to the parents has been revised to explain the emergency plan including information regarding our lockdown plan and accommodations in the event of an emergency. Requirement: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility. Correction: For staff person #2, she was able to verify her hours working with children on 11/26/24. For staff person #5, he was not able to provide verification of his hours, therefore he has been working as an assistant group supervisor rather than a group supervisor.
