Parent Access & Participation (3270.23)

Based on interviews with Staff, it was confirmed that Staff Person #3 and #4 hid Child #1, a young toddler, from a parent on 3/18/26 at 1:30 when the parent arrived at the facility to pick up the child. Staff #1 and #2 also knew the whereabouts of the child but did not disclose this to the parent. At this time, the child was in the OT Room being supervised by Staff Person #3 and #4 at naptime with 9 other YT/OT. Upon hearing the parent enter the facility, Staff Person #3 instructed Staff Person #4 to take the child to the back room so the parent would not know where the child was. Staff believed they were not supposed to release the child to this parent because they were given direction by Staff Person #5 that the child was only required to be released to this parent on Fridays due to the wording of a custody agreement. Staff Person #5 admitted to being unclear of the wording in 3270.23 and believed they were only required to release the child to the parent on Fridays. Requirement: A parent of a child in care shall be permitted free access, without prior notice, throughout the center whenever children are in care, unless a court of competent jurisdiction has limited the parental right of access to the child and a copy of the order is on file at the facility. Opportunity shall be provided for parents to participate in the facility's program. The operator shall maintain a yearly file which documents general announcements to promote parent participation. The file shall be updated annually. Correction: The center Director has instructed all staff to release children to a parent unless as stated by the Certification Representative, we have an order from CYF limiting the parent to Supervised visits. Staff person #5 had received from the parent of child #1 an order of Court custody from the Court of common Pleas of Allegheny county (Family Division) which staff person #5 believed to be a court of competent jurisdiction per regulation 3270.23. The contents of the custody order LIMITED the other parent to SPECIFIC dates and times to have custody of child #1 which staff person #5 believed had to be adhered to in order to be in compliance with both the state regulation and the court order. The wording in regulation 3270.23 does not state that limited access to a child is the equivalent of supervised CYF visits. Regulation 3270.23 does not spell out that a order from a court of competent jurisdiction does not include Family Court and that court ordered custody is a worthless piece of paper to have on file since a center is not able to enforce the order. The idea that parents that have custody issues should not have access to safe and affordable child care because it puts the center in the middle is an unfortunate stance to take and goes against the entire purpose of trying to provide a safe and stable environment for all children no matter what their parents situation might be. Staff person #5 is completely disheartened to have been citied for violating a regulation that is in essence not what it seems to be. Directors already have to be teachers, accountants, therapist, cooks, janitors , Physicians assistants and now we have to add on being schooled in the area of Regulatory Law in order to read between the lines of regulations that should be be black or white. This regulation seems very grey and should at a minimum be reworded to ensure that it can actually be adhered to in it's entirety . Inspection: Complaints- Legal Location. General Health and Safety (3270.21)

Based on a review of video footage and staff interviews, it was confirmed that a physical altercation took place between a parent and Staff Person #1 on 3/18/2026 at 1:33 PM in the YT Room. The parent is seen punching the staff person multiple times. After the third punch, Staff Person #1 began to punch back. Although it was confirmed that the staff person was striking back in self-defense, this incident put the general health and safety of the children in care (two infants and one young toddler) at risk. Requirement: Conditions at the facility may not pose a threat to the health or safety of the children. Correction: Staff have been advised not to defend themselves if they are being assaulted while supervising children. Staff should wait until another staff person is able to step into the room and take over supervision of the children. At that point, the staff person that is being assaulted is to carefully move towards the nearest exit door and once outside of the center and away from the children, they may begin to defend themselves. Please note that in the video the staff person was supervising so well that they were able to stop the assailant from moving towards the children and push them back and out of the classroom door while getting their nose broken and requiring seven stitches in their mouth in the process. The parents of the children in the classroom, center management, the police officers on scene and staff that work at this center consider the staff person to actually be a hero that went above and beyond to ensure the health and safety of the children in their care. Supervised at all times (3270.113(a))

Health and Safety Training (3270.31(f))

Staff person #2 has not completed the following required pre- service training within 90 days of their date of hire: Health and Safety Training Part 2. (See LIS code sheet) Requirement: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children at a minimum by, an AGS or higher who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility. Correction: Staff person #2 completed part 2 of the health and safety training. Verification of this will be submitted to our certification representative. The most recent mandated reporter trainings in the file for Staff Person #3 exceeded 60 months between trainings. The State Police Clearance in the file for Staff Person #1 did not contain a disseminated date. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Correction: The file for staff person #1 had a date at the top of the page but the bottom portion was cut off. A new Criminal clearance was completed and given to the certification Representative and is also in the staff persons file. Inspection: Renewal. Protective Outlet Covers 5 yrs. or less (3270.65)

Observed one childproof electrical outlet, which was not functioning properly, below the clock in the OLT Room. Requirement: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger. Building Surfaces (3270.76)

Observed damaged ceiling tiles surrounding the smoke detectors in the Preschool and School Age Rooms. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. No peeling paint or plaster (3270.77(a))

Observed flaking plaster from a hole in the wall under the teacher board in the OLT Room. Requirement: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility. Correction: The hole was covered temporarily on 10/20/25 until a permanent fix with plaster is able to be scheduled and completed by maintenance personnel. Inspection: Renewal. Services proceeded (3270.123(a)(3))

The most recent child service reports in the files for Child #1 and #3 exceeded 6 months between reports. Requirement: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). The most recent parent updates for the fee agreements in the file for Child #3 exceeded 6 months between updates. Requirement: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information. No harsh language (3270.113(d))

Based on staff interviews, on July 3, 2025, Staff Person #1 raised their voice, used profanity, and argued aggressively in the presence of six children in Room 3 (OLT). During the argument, Staff Person #1 stated that they "work their a** off." Requirement: A facility person may not use harsh, demeaning or abusive language in the presence of children. Based on staff statements and video recording, Staff Person #2 recorded a ten second video of 11 toddler-aged children walking to the park and then posted the video recording on their personal social media. Requirement: A facility person may not disclose information concerning a child or family, except in the course of inspections and investigations by agents of the Department. Correction: Staff person #2 was counseled and given a verbal warning concerning her post with the children on social media and then subsequently terminated. Inspection: Complaints- Legal Location. Comply with CPSL (3270.32(a))

Staff Person #1 has not completed mandated reporter training within the last 60 months. This is evidenced by the previously documented mandated reporter training on file being dated March 16, 2020. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to Child Protective Services). Until such time as the required training has been completed, Staff Person #1 must be supervised when interacting with children at a minimum by an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff persons available to supervise Staff Person #1, Staff Person #1 may not work in a childcare position at the facility. Exceeding Capacity (3270.61(h))

On July 8, 2025, at approximately 9:30 AM, 15 preschool age children were observed receiving care in Room 4 (PRE) that has a total capacity of 12. Requirement: The capacity established for an indoor space may not be exceeded. Correction: 3 children were moved into another room that had open capacity available. Every 60 days (3270.94(a)(1))

The fire drill log for the facility conducted fire drills on 11/20/24 and 2/26/25 (96) which is over the required 60 days. Requirement: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days. Correction: A fire drill was completed the same day that the Compliance Manager realized that the center Director had failed to complete fire drills in a timely manner. Devices must be compliant (3270.95(a))

The fire alarm 30-day test log includes test dates 10/22/24-11/20/24 and 11/20/24-2/26/25, which are all more than 30 days apart. Per Chapter 3270 Act 62 regulation updates on May 24, 2021, all fire detection devices or systems must be tested at least every thirty days. Requirement: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). Correction: Testing of the fire alarm had ceased due to an annual passing fire alarm system report being obtained by the center. Management was not aware that a stand alone building or structure was still required to test every 30 days. Clarification was received on 3/18/25 and an alarm test was conducted and documented at the center. 10/22/24 and 11/20/24, I believe are exactly 30 days apart. Training regarding plan (3270.27(c))

The file of staff #1 contained documentation of emergency plan training dated 7/14/2023 but did not contain documentation of current training within the last 12 months. Requirement: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. Age and Training (3270.31(e)(4)(i))

The file of staff #2 contained documentation of pediatric first aid and pediatric CPR updated on 10/11/2024, which was after the expiration of the prior training dated 3/26/2022. Requirement: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. The mandated reporter training on file for staff #3 was not conducted by an approved training organization for mandated reporters working in child care. Staff evaluations (3270.34(a)(6))

The annual evaluations exceeded 12 months for staff #1 (dated 6/3/2023 and 7/17/2024). Requirement: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months. Heat Source (3270.71)

The metal on the front of a space heater being used in the infant classroom exceeded 110 degrees Fahrenheit and was placed in an area which was accessible to the children in the lap of staff #2. The hot water in the young toddler room also exceeded 110 degrees Fahrenheit. Requirement: Hot water pipes and other sources of heat exceeding 110° F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact. Correction: The space heater was removed from the child care space. All staff were already aware space heaters or any type or portable heating device is not permitted in the child care space. while children are present. The staff person might be terminated for not following this regulation. The hot water in room # was turned off under the sink. Inspection: Renewal. Building Surfaces (3270.76)

In the outdoor play space, an area approximately 6 inches by 6 inches of the wooden retaining wall was damaged and appeared to be disintegrating. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Handwashing signs (3270.82(h))

The portable sink in the young toddler classroom did not have a posted handwashing sign, Requirement: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.
