At the time of the Unannounced Visit conducted on 10/17/2025, Staff Person #1 was observed working alone. The file of Staff Person #1 did not have contain verification of education to qualify Staff Person #1 as an Assistant Group Supervisor. Requirement: An assistant group supervisor shall have attained one of the qualification levels specified at § 3270.36(b)(1-5). A facility person's record shall include verification of child care experience, education and training prior to service at the facility. Correction: Provider will ensure that Staff Person #1 does not work alone. Provider will also ensure that education verification for Staff Person #1 is obtained, if Staff Person #1 is unable to provide Education Verification documents to qualify Staff Person #1 as an Assistant Group Supervisor by the correction date, Staff Person #1 will be terminated. At the time of the Unannounced Visit conducted on 10/17/2025, Staff Person #1, hired 03/31/2025 did not have an initial health assessment on file including the results of an initial tuberculin skin test. Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. Correction: Provider will ensure that Staff Person #1 obtains a Staff Health Assessment including results of the tuberculin skin test. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. At the time of the Unannounced Visit conducted on 10/17/2025, Staff Person #1 was observed working alone. The file for Staff Person #1 did not contain verification of completed Pediatric First Aid and Cardiopulmonary Resuscitation Training. Also, the file for Staff Person #1, hired 03/31/2025, did not contain verification of the completion of the required Health and Safety Trainings. Requirement: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Correction: Provider will ensure that Staff Person #1 completed Pediatric First Aid and Cardiopulmonary Resuscitation Training and the required Health and Safety Trainings. Verification of the completion of both trainings will be kept on file. If Staff Person #1 is unable to obtain the required trainings by the correction date, Staff Person # 1 will be terminated. Restraints prohibited (3270.113(e))

As a result of the Complaint Investigation conducted on 04/17/2025, it was determined that Staff Person#1 used tape to restrict the movements of Child #1. Requirement: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Correction: Staff Person #1's employment was terminated by the Kaiserman JCC, citing the violation of 55 PA Code Chapter 3270.11e, "A facility person may not restrain a child using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. " Inspection: Self-Reported Non Compliance. As a result of the Complaint Investigation conducted on 12/11/2024, Child #1's diaper was not changed for at least 45 mins after Staff #1 was made aware that the child's diaper was soiled with feces. Requirement: A staff person shall check a child's diaper at least every 2 hours and whenever the child indicates discomfort or exhibits behavior that suggests a soiled diaper. A staff person shall change a child's diaper when the diaper is soiled. Correction: A staff person will check a child's diaper at least every 2 hours or whenever a child indicates discomfort or exhibits behaviors that suggest a soiled diaper. As a result of the Complaint Investigation conducted on 12/11/2024, Child #1 was left with a therapist alone on the facilities premises in a room not measured for childcare space, unsupervised by a staff person. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times.
