According to staff statement, an older toddler age child was left out on the playground by himself for 10-15 seconds in the middle of October 2025. A new staff was bringing the children in and did not do the count outside before they came in. Once inside the count was done and it was realized at that point that the child was not with the group, and another staff ran out to get the child outside on the playground. Requirement: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Correction: Each staff person will be responsible for a specific group of children. Staff will maintain their groups by counting and identifying children in their care multiple times a day including but not limited to during transition times, during arrival and departure times, when there is a staff change, and anything entering or leaving a room. According to staff statements the facility is sometimes out of ratio, especially when someone calls off at the last minute and they are waiting for someone to come in to cover. Specifically on March 3, 2026, in the infant room there was one staff with 1 Infant, 4 young toddler, and 2 older toddlers for about 10 minutes. Requirement: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). Correction: Child care groups will be appropriately staffed when children are in care, following the state mandated ratio. Staff will be scheduled earlier than children's arrival times. Staff will be in their child care space at scheduled start time, The Director will step into counts when necessary. Additional floater staff will be scheduled for times of arrival to prevent going out of ratio, The age of the youngest child will determine the staff:child ratio and group size. Per staff statements and observation of video recordings, Staff #3 has grabbed and pulled children by their arm or hand when the child was not following Staff #3's directions. On 4/29/25, after Child #1 hid from Staff #3 on the playground, Staff #3 grabbed and pulled child #1 by the arm and by the hand during the transition from the outdoor playground to the child care room. Requirement: A facility person may not use any form of physical punishment, including spanking a child. TIERED LIS: 1. A facility person may not use any form of physical punishment, including spanking a child. This portion of the plan shall have an immediate correction date. 2.
