Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. Staff assigned to specific children (3270.113(a)(1))

According to staff statements, on 3-11-26, child #1, a preschooler, was left alone in the pre-k room for approximately 10 minutes without a staff person present in the room. During naptime, there was a tornado drill and staff person #2 took 10 preschoolers to the front hallway. Staff person #1 was waking up 3 preschoolers to take them to the front hallway. It was during the transition of staff person #1 taking the 3 preschoolers to the front hallway that child #1 was left alone in the room sleeping until the staff person returned to the room. Requirement: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Correction: All staff persons will be assigned the responsibility of a specific group of children and will know the names and whereabouts of all children in their assigned group. All staff persons will be physically present with the children in their assigned group on the premises and on facility excursions. School directors will randomly check to make sure facility persons know the whereabouts of all children in their care. Inspection: Self-Reported Non Compliance. Supervised at all times (3270.113(a))

The operator shall provide a date for when this update will be completed. 3. The facility will conduct a training on the updated Emergency Plan, focusing on the evacuation for shelter-in-place and evacuations. The operator shall provide a date for when this training will be completed. 4. Subsequent to this training, the facility shall conduct an emergency drill requiring shelter-in-place, with the director and Manager observing. The Emergency drill shall be documented on the department-provided form and submitted to the regional office, with a written review of the drill by the Director and the Regional Manager. The correction date for this portion of the plan is to be within two weeks of when the emergency plan training was conducted. Copies of the evacuation, lockdown, and shelter-in-place procedures from the emergency plan will be kept in the classroom binders for the staff to review often. The form will be submitted to the regional office. Based on video recording, on 6/17/25 in the Young Toddler Room, Staff Person #2 was observed discarding a soiled diaper without using a hands-free covered trash can at approximately 12:22pm and then again at 12:35pm. Requirement: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can. Correction: Staff were reminded and retrained on proper use of the handsfree trash cans in the facility. Handsfree trash cans are located in all classrooms, bathrooms and diapering areas. Clean, age appropriate (3270.106(a))

Based on staff statements, Child #1, a toddler, was not provided with individual rest equipment and instead slept in a chair while in care at the facility. Staff indicated that a cot was never assigned because the child's parent did not provide a sheet, as required by the facility. Requirement: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child. Correction: The staff were retrained on proper procedures regarding children who begin to fall asleep during non-designated rest times. Based on staff statements, multiple staff persons were reported to interact with children using an aggressive and harsh tone of voice. It was determined multiple staff persons screamed in children's faces and made statements such as, "You're a bad kid! Go sit down! Go lay down! Stop crying! Enough." Requirement: A facility person may not use harsh, demeaning or abusive language in the presence of children. Based on video recording, Staff Person #1 was observed in the Young Toddler Room grasping a child by the wrist and pulling the child across the room toward their cot. As the child was being pulled, the child's legs lost balance, and the child landed on their hands and knees. Then, Staff Person #1 pushed the child onto their back causing the child's head to make contact with the back of the cot. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Staff Person #1 was terminated. Based on video recording, on 6/17/25 in the Young Toddler Room, Staff Persons #1 and #2 were observed sweeping the floor with a broom and then used the broom that had been visibly soiled to sweep food off tables where children were seated and eating. Based on video recording , on 6/17/25 in the Young Toddler Room, a container of Swiffer wet pads that are labeled Keep Out of Reach of Children was accessible to children in care. Multiple children were also observed playing with a mop that had a Swiffer wet pad attached and were observed pushing the mop around the room. Requirement: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Based on video recording, on 6/17/25 in the Young Toddler Room, Staff Persons #1 and #2 were observed changing diapers without washing their hands or assisting the children with handwashing. Handwashing also did not occur between diaper changes. Requirement: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. Based on video recording, on 6/17/25 at approximately 12:13pm in the Young Toddler Room, Staff Person #2 was occupied with a diaper change in the restroom and out of view of the children. During this time, Staff Person #1 was observed with their back turned to the children and their head facing downward while placing a sheet on rest equipment. As a result, 9 children in the room were momentarily not under active supervision. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Correction: Staff were retrained on supervision and ratio guidelines in a staff meeting held on 8/7/2025.
