Staff persons #1 and staff #2 were responsible for a group of 11 preschool aged children. Staff person #1 identified 3 of the children as being in their care group, and staff person #2 identified 6 of the children as being in their care group. Staff person #1 and staff person #2 each missed 1 child in their groups. Requirement: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Child #1 was in care at the facility on Monday, 11/3/2025. During multiple interviews with staff, it was reported that the child was acting normal upon arrival to the facility and was very upset by the end of the day. The child's parent reported that the child was inconsolable when picked up that day. On 11/4/25, the child was taken to the hospital and was diagnosed with a buckle fracture to the left leg. The medical team at the hospital determined that the child could not have caused the injury. The injury would have occurred due to the action of another person not the child. During an interview on 11/5/25, without prompting, staff person #1 immediately named child #1 and stated a concern for a leg injury. Staff person #1 stated this was reported to both the mother of the child and to the person in charge at the facility, which both of them deny. Requirement: TIERED LIS 1. Conditions at the facility may not pose a threat to the health or safety of the children. A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file. This portion of the plan shall have an immediate correction date. 2. Facility leadership must complete TA (with an approved Health and Safety Consultant) to write (or revise) and implement a policy regarding staff response to accident, injuries and other medical emergencies, including actions taken when facility staff do not adhere to the policy. Facility leadership will submit the policy to DHS for approval. After the policy is approved by DHS, all staff will be trained on the center policy. All staff must sign and agree to adhere to the center policy. Documentation that all staff were trained and signed the policy must be kept on file at the facility. The operator shall provide a date for when this correction will be completed. Correction: 1. 12/5/25 Shining Stars Childcare LLC will continue to ensure that conditions at the facility do not pose a threat to the health and safety of the children in care. The facility will continue to document all accidents, injuries, and illnesses involving a child on the child's record. The original report will be provided to the child's parent or guardian on the same day the incident occurs. A second copy will be retained in a designated accident file at the facility, and a third copy will be retained in the individual child's file. 2. Facility Leadership completed TA on 12/17/25 with an approved Health and Safety Consultant to draft or revise a written policy addressing staff in response to accidents, injuries and other medical emergencies. The policy will include procedures for responding to emergencies as well as corrective actions to be taken when staff do not adhere to the policy. Upon completion, the policy will be submitted to the Department of Human Services for review and approval. Following DHS approval, all facility staff will be trained on the approved policy by 1/30/26. Each staff member will be required to sign an acknowledgement confirming receipt of the policy and agreement to adhere to its terms.
