Evidence of violation: On unannounced visit it was noticed that additional seatbelts had been installed in the maroon 15 passenger van. Because this is a modification to the original way the vehicle was manufactured, certification by the vehicle manufacture is needed to ensure the vehicle is in compliance with state and local laws. Method of correction: 1. The maroon van needs to be inspected by Highway Patrol and/or follow any recommendation they suggest. 2. Contact the vehicle manufacturer and have them sign off stating the vehicle is safe to transport more passengers than the amount of seatbelts originally installed by the manufacturer. 3. Provide to licensing verification that the vehicle has passed inspection to transport for the additional seatbelts currently in the van and that this is in accordance with federal, state, and local transportation laws. Evidence of violation: The vehicle used to transport children only had 19 seatbelts and 20 passengers in the van. One child was improperly restrained. Seat belts found are as follows: driver, front passenger, 1st row (4 seat belts), 2nd row (4 seat belts), 3rd row (4 seat belts), back row (5 seat belts). One child in the back row was improperly restrained. Video footage shows the van being loaded with 19 children, 1 adult driver and driving out of the parking lot. Method of correction: Limit the number of children to be transported in the maroon van to 15. Center director and staff are to review ND Child Passenger Safety Laws that licensing specialist emailed and gave a hard copy to center director. Upon reviewing the ND Child Passenger Safety Laws sign off acknowledging they have read and understand. Wording was changed from 18 passengers to 15 passengers following Highway Patrol indicating they would not approve for more than 15 passengers in the vehicle.
