14.02 — Administration
One staff member [redacted] in the process of completing BRC. Corrective action: There was an error in the staff member's birthdate. It was corrected and she has been fingerprinted.. Regulation: Policy: In order to ensure that employees or other persons regularly providing child care or support services with potential for unsupervised contact with children in any program or facility licensed and/or funded by EEC are appropriate for serving in their positions, a Background Record Check (BRC) shall be performed on all candidates for positions in such programs or facilities, as provided in 606 CMR 14.00. A BRC shall consist of, at a minimum, a Massachusetts Criminal Offender Record Information (CORI) check; a DCF Background Record Check; a SORI check and a fingerprint-based check of state and national criminal history databases. Further, a Background Record Check shall be performed periodically, but no less often than every three years, on all persons in such positions. It is the policy of EEC that convictions of certain crimes, and certain other conduct, pose an unacceptable risk to the children served by EEC and its licensed and/or funded programs. 606 CMR 14.00 sets forth minimum standards for review of background information. Stricter standards may be set by EEC licensed and/or funded programs. While effective immediately, EEC shall implement the provisions of 606 CMR 14.00 in phases. 7.07(07)(d), 7.07(07)(e), 7.07(10), 7.07(13)(d) — Physical Facility - Outdoors
The swing set chain has rust. Two riding toys and the basketball hoop have rust on them. All equipment must be free of rust and peeling paint. The fence has a potential entrapment area. The playground does not have adequate fall zones under the swing set and climbing toys. Corrective action: The rusty chains on all three swings have been replaced. The two tricycles that had rust on them have been removed. One of the parents donated a new tricycle to the preschool. The standing basketball hoop that had rust on it has been removed. A wooden board has been bolted behind the chain link fence to eliminate a gap for possible entrapment. A new chain has been wrapped around the playground gate to make it secure and rust free. I plan to organize a parent workday to help with the playground mulch... We will remove one or both small climbing structures, and rake all all the mulch to the swing area to meet the 9" depth requirement.. Regulation: The outdoor play area must be free from hazards including but not limited to: a busy street, a parking lot, poisonous plants, water hazards, debris, broken glass, chipping, peeling or flaking paint, dangerous machinery or tools, and weather-related and environmental hazards or small objects that could present a choking hazard to young children. Any such hazard must be removed or fenced by a sturdy, permanently installed barrier which is at least four feet high or otherwise protected or removed, as appropriate., If the outdoor play space is located on a roof, it must be protected by a barrier at least seven feet high, which cannot be climbed by children., Indoor Space. The indoor space must be clean, safely maintained, well-ventilated and well-lit, of sufficient size for the children served, and must encourage play and learning., All play equipment, fences and structures must be free of entrapment hazards.
