    The fence or barrier, separating the home from the swimming pool, did not meet the minimum requirement of four (4) feet in height, in the absence of an operable pool alarm. FDCH/LFCCH Handbook, Section 7.7, A Comments: At the time of the inspection, the provider had an above ground pool on her patio without a 4 ft fence or barrier around the pool or a pool alarm. There was a plastic cover over the pool with standing water on top. The children have to walk through the patio where the pool is to get to the play area and there is only one lock on the sliding glass door that goes out to the pool. TA was provided that the provider will need to remove the pool by the due date, and the children will not be able to go outside until the pool is removed. TA: If the home has an in-ground or an above-ground swimming pool, more than one foot deep, it shall have either a fence or barrier on all four sides, at a minimum of 4 feet in height, separating the home from the swimming pool, or a pool alarm that is operable at all times when the children are in care. The exterior wall of the home does not constitute as a fence or barrier. • All doors or gates in the fence or barrier shall be locked at all times when children are in care and when and when the children in care are not using the pool. • The fence or barrier shall not have gaps or openings that would allow a young child to crawl under, squeeze through, or climb over the barrier. • The wall of the above-ground pool may be used as a barrier; however, such structure must be at least 4 feet in height. • Any ladders or steps that are the means of access to an above-ground pool must be always removed when children are in care and when the pool is not being used by children in care. • In addition to the fence, barrier, or pool alarm the home operator shall ensure that all exterior doors leading to the pool, spa, or hot tub areas remain locked up at all times while children are in care. • Barriers may be temporary in nature but must be sturdy and meet all the above requirements and be in place during all times when children are in care. • The swimming pool shall be maintained by using chlorine or other suitable chemicals. • Spas or hot tubs must meet the same barrier requirements for swimming pools or may be covered with a safety cover that meets requirements of Section 515.25(1), F.S.
