2.4.1(F), Handbook: No person can be an operator, owner, or employee of a child care facility while using or under the influence of narcotics, alcohol, or other drugs that impair a persons ability to provide safe care and supervision. An employee was under the influence during operational hours. Facility/Storage [SR] Comments: Quality Assurance Specialist visited the school on 3/2/2026 to conduct a complaint inspection. After speaking with the director (K.W.) in the office, I noticed that her breath smelled of alcohol/liquor. I proceeded to continue my inspection but noticed the smell in her breath continuously when speaking with her. The director seemed confused at times and asked me to repeat my question a couple of times. I eventually told her that I had to ask her a question in private, so she asked me to step outside to the front of the school. We went outside, where I informed her that I noticed that her breath smelled like alcohol. She proceeded to say that this situation is tough, she has had a lot going on, the police and DCF were at the school earlier in the day, etc. She stated that she had gone out to lunch with her daughter earlier that day and had one drink, which explains the smell. I stated to her you know better and shouldnt have done that. She replied that she was leaving for the day, and that she was off the clock. I asked her to show me her timecard to which she said she doesnt clock in and out because she is a salaried employee. I told her that she was in the school with the children to which she replied that she had come to drop off some supplies, but she was going to leave. Prior to notifying her about the alcohol smell, the director never expressed that she was not working. When I arrived, a staff member opened the door and I indicated that I needed to see the director. The staff member went to retrieve her from the 2 y/o classroom. The director was observed wearing her Nowtech employee shirt. When I explained why I was there and expressed wanting to see the rooms in question, she took me to both the VPK classroom and the infant classroom. During the remainder of my visit, she was performing her job as a director which included talking to parents and teachers and helping release children to parents. Sec. 7-33(e), Ordinance: Direct supervision means watching and directing the childrens activities within close proximity within the same room inside or within a designated outdoor play area and responding to each childs needs. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [infant injury after fall from teacher's lap]. Ratios/Discipline [SR] Comments: A complaint allegation was received alleging that an infant received two fractures, and a hematoma. It is alleged that the child (L.M.) was sitting on a workers lap and fell. The staff members alleged that L.M. behaved normally, and the staff members provided an ice pack on L.M.s face. FINDINGS: A statement was received on-site on 3/3/2026 from the second teacher (A.F.)that was in the room when the incident happened on 2/27/2026. A statement was received from the teacher (Y.R.) that was holding the eight-month old child via phone call on 3/4/2026. Per the teacher holding the child (Y.R.), she only had one infant, so she remained in the VPK room with the rest of the children. Ms. Y.R. was sitting on a chair, with the infant child was drinking a bottle of milk while sitting on her lap. Then, an older child came up to her and asked for a hug. She let go of the infant child to give him a hug with both hands, and the infant child fell over to the floor. She quickly picked up the child and soothed her. She took her to the infant room and gave her a snack while attempting to put an ice pack on her face/forehead. Per the second teacher in the room (AF), she stated that she didnt see the incident because she was opening the main entrance door for a child that had arrived when the incident happened. She heard the infant child crying and when she returned to the classroom, the teacher had the child in her arms. Video footage of incident was missing. Video footage of teacher entering and tending to the child in the infant room was also missing. This complaint is substantiated as inadequate supervision occurred when the teacher let her go, allowing the child to move and fall to the floor. Per the MRI results, The child received a left frontal calvarial fracture, a Left orbital roof fracture, and a hematoma in the upper part of the left eye socket. This standard is a class level 2 and it was previously cited on 6/4/2025. However, it is being escalated to a class level 1 non-compliance due to the severity of the childs injuries. 08. Child care personnel and volunteers at a facility must be assigned to provide care to a specific group of children and be present with that group at all times during the day, including during meals, napping, and transportation of children 2.4.1(B), Handbook: Children must never be left inside or outside the facility, in a vehicle, or at a field trip location by themselves. Lack of direct supervision occurred when [a school age child was observed napping in the lobby area floor]. Ratios/Discipline [SR] Comments: Upon arrival to investigate a complaint inspection, a school age child (JL) was observed in the lobby/office area without adult supervision. A teacher opened the entrance door and went to locate the director, Ms. K.W., leaving the school-age child unattended. The director, Ms. K.W., was seen coming out of the two-year-old room, toward the lobby/office. The teacher who opened the door did not return to the lobby/office and the child remained without supervision. When the director approached the lobby/office, I asked her if the child was isolated for being sick to which she answered no. The director, Ms. K.W., said that Hes always tired from school and takes a nap there as soon as he arrives. At that time, there was no other adult in the lobby/office, just me and K.W. I asked to see the room where the incident alleged in the complaint happened and the director walked into the VPK room with me, once again, leaving the child unattended. I also went into the infant room and the director went with me, still leaving the child unattended. After visual inspection of such rooms, we proceeded back to the lobby/office and as I was checking files, the director asked one of the staff members, who she said was the assistant director, for assistance. The assistant director was not in the lobby/office during the first portion of my inspection. A Class 1 non-compliance and Notice of Violation is being issued. Asphalt, concrete, hard packed dirt, hay, grass or leaves are unsuitable for use in the use zone area. Sec. 7-33(e), Ordinance: Direct supervision means watching and directing the childrens activities within close proximity within the same room inside or within a designated outdoor play area and responding to each childs needs. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [child received an injury on the head while in care]. Ratios/Discipline [SR] Comments: on 5/29/2025, Child fell off a chair and had a laceration on the back of her head. The child was standing on a chair with another child and playing around, they tipped over the chair and fell. She has a small laceration on the back of her and it was bleeding. It was reported that the staff did not realize what occurred until staff heard her crying and saw the bleeding. FINDINGS: A complaint inspection was conducted on 6/4/2025 and statements from the director and teachers were received. Per teacher A, She was taking the children to the restroom when the incident happened. When she returned from the restroom, she saw two children crying and one of them was the child in question. She had to go clean the bathroom so she could not tend to the child then. When she returned from cleaning the restroom, the child was still crying so she sat down and picked her up attempting to carry her and the child dropped her body on the teacher's lap. At this point, the child was face down so the teacher saw blood running down the child's neck and unto her collar. She then called teacher B over to look at the injury and the director was notified. Per teacher B, the incident happened after the children were done having snack. She did not see the child fall on the floor because her back was turned. The child walked up to the teacher crying with her arms raised, as if she were asking to be carried. She stated that she held the child by the hand and walked around the room with her. A few minutes later, she picked her up and wiped he face. Then, Teacher A walked in the room and noticed it when she picked up the child. Per the director, the child had only been in that classroom for a couple months so the routines were new to her. The teacher didn't think anything was wrong because the child cried a lot during the day. A conversation with corroborating agency who reviewed the footage confirmed the statements received from the teachers. The teachers didn't see the incident when it occurred. Two children were climbing on chairs and the child in question fell on the floor. She walked up to teacher A, crying, and asking to be held. The teacher held the child's hand and walked around with her. She eventually picked her up, wiped her tears and put her back down. The second teacher came in and out a few times with some of the children and the last time she came into the room, She was the one that tended to the child and saw the blood on the child. A video of the incident was available but I was not granted access to view the video during inspection. Complaint is substantiated and a non-compliance for inadequate supervision is being issued. The teacher was in the room but was not directing the child's activities at the time the child climbed and fell off the chair. 08. 3.8.4(A) and (C), Handbook: During the facilitys license year, fire drills utilizing the alarm system, approved by the local fire authority, must be conducted monthly at various dates and times when children are in care. The operator must maintain a written record of the fire drills showing the date, number of children and child care personnel in attendance, evacuation route used, and time taken for all individuals to evacuate the premises. Each fire drill record must be maintained for a minimum of 12 months from the date of the fire drill. There was no documentation available to show that monthly fire drills have been completed for the month(s) of [bfgjkg]. (Section 2.1(A) Health and Safety, Page 3) License/Certificates [SR] Comments: At the time of inspection, licensing monitor requested to complete an observed fire drill. Director was required to contact building owner to initiate fire drill. At the time of this contact, director stated that the alarm system approved by the local fire authority was not utilized for drills throughout the licensure year. Alarm is only utilized at the request of licensing monitor. Drill was not conducted due to delay in contacting alarm company to place system on test/drill mode. Provider resolved at time of inspection during contact with owner. Licensing monitor will conduct an observed fire drill prior to license expiration. Additionally, provider is required to complete the next pending fire drill utilizing the alarm system approved by the local fire authority by the due date. Sec. 7-5.03(e), Ordinance: There shall be a minimum of six (6) inches of resilient, impact resistant material such as sand, mulch, grass, etc., under all permanently installed equipment unless approved rubber padding is used.The six (6) inch resilient, impact material shall not be on top of a non-yielding surface for facilities licensed after the date this Ordinance is adopted. Non-yielding surfaces, such as concrete, gravel, rock, or paving shall not exceed one-fourth (1/4) of the required outdoor play space.3.12(D), Handbook: Permanent or stationary playground equipment must have a minimum of 6 inches in depth of loose ground cover (such as but not limited to: mulch, shredded rubber chips, or sand) or other shock absorbing protective surface under the equipment and within the fall zone that provides resilience, and is maintained to reduce the incidence of injuries to children in the event of falls. Asphalt, concrete, hard packed dirt, hay, grass or leaves are unsuitable for use in the fall zone area. The playground surface was insufficient. Indoor/Outdoor Space [SR] Comments: At the time of inspection, licensing monitor observed inadequate surfacing under climbable equipment. The fall zone (sand) is no longer 6inches in depth and has created trip hazards around the play space. The surface material (green carpet) on top is torn and has holes in several places.
