   2.8(A-B), and (F)(1-9), Handbook: The child care facility shall adopt a discipline policy consistent with Section 402.305(12), F.S., including standards that prohibit children from being subjected to discipline which is severe, humiliating, frightening, or associated with food, rest, or toileting. Spanking or any other form of physical punishment is prohibited. The child care facility operators, employees, and volunteers must comply with written disciplinary and expulsion policies. The following discipline techniques shall be prohibited in the child care facility: the use of corporal punishment/including, but not limited to: hitting, spanking, shaking, slapping, twisting, pulling, squeezing, or biting; demanding excessive physical exercise, excessive rest, or strenuous or bizarre postures; compelling a child to eat or have in his/her mouth soap, food, spices, or foreign substances; exposing a child to extremes temperature; rough or harsh handling of children, including but not limited to: lifting or jerking by one or both arms; pushing; forcing or restricting movement; lifting or moving by grasping clothing; covering a childs head; isolating a child in an adjacent room, hallway, closet, darkened area, play area, or any other area where the child cannot be seen or supervised; binding, tying or restrict movement, or taping the mouth; using or withholding food or beverages as a punishment; toilet learning/training methods that punish, demean, or humiliate a child; any form of emotional abuse, including rejecting, terrorizing, extended ignoring, isolating, or corrupting a child; any abuse or maltreatment of a child; abusive, profane, or sarcastic language or verbal abuse, threats, or derogatory remarks in front of the child or about the child or childs family; placing a child in a crib/portable crib for a time-out or for disciplinary reasons. A method of discipline was used that was inappropriate in that [a child was taped to a chair]. Ratios/Discipline [SR] Comments: Complaint alleges that on 11/08/2025 at approximately 8:30 am, The teachers taped a child to a chair. The teachers taped his arms, legs and torso to the chair. They did this because they wanted EJ to learn to be still. EJ is a busy child. The teachers took pictures of EJ being taped to the chair. The teachers laughed at EJ being taped to the chair. The director and curriculum director were made aware and did not report the incident. EJ's parents were not notified. There are concerns about the teachers still being allowed to be in the same classroom as EJ. FINDINGS: A complaint inspection was conducted on 11/17/2025 and statements were received from the director, regional director, and teachers. Per the Director (E. Garcia), she was notified about the alleged incident on Friday, 11/14/2025, by Ms. A. Zupicich (Regional Director). A picture of the child tapped to the chair was sent to the H.R. department. The date on the allegation is wrong, we do not know the exact date but it is believed to have happened some time in early November. Per the Regional Director (A. Zupicich), On Friday she was alerted by H.R. that there was concern with one of the schools and a picture that was sent to them. She went to the center that same day and the director was not aware of the incident. She spoke to the teacher D. Rodriguez, through a Spanish translator employed by them. Ms. Rodriguez explained to her that the assistant director, Ms. Rasquin, went in the room and wrapped the child to the chair with tape. Ms. Rasquin thought it was funny and took a picture of the child. The child's teacher did not think it was funny and she told the assistant director to take the tape off immediately. Ms. Rodriguez took the tape off herself. Ms. Fernandez who was also in the room stated that she didn't see anything because she was changing a diaper at the time of the incident. Per the Teacher (D. Rodriguez), the incident occurred the morning of 11/7/2025. The assistant director went in the classroom with tape in her hands. She doesn't recall what EJ was doing at the time. The assistant director went to the child and taped him to the chair. She was laughing as she did it and took a picture of the child. Ms. Rodriguez told her to stop and proceeded to take the tape off the child. She doesn't believe the assistant director was being mean or malicious. She thought that she was playing with the child. Per second teacher (A. Fernandez), the assistant director came into the classroom with classroom supplies in her hand. She thought it was normal for her to go in the classroom because she is also an employee of the school and she works in the office. Ms. Fernandez was doing diaper/pullup changes and potty training in the restroom that is located inside the classroom. She didn't see or hear anything because her attention was on the children that were with her inside the restroom. She found out about the incident on Friday, 11/14/2025 when corporate visited the school. Per the assistant director (D. Rasquin), Ms. D. Rodriguez called the office and asked her to go to the classroom, thinking she was speaking to N. Barboza. She went to the classroom and the teachers said to her, 'Oh, I thought it was Narelis." Then, Ms. Fernandez proceeded to show her a picture of the child taped to the chair and refused to take it off because they wanted Ms. Barboza to see it first. The assistant director took a picture of the child and went back to show the director (E. Garcia) and assistant director(N. Barboza). N. Barboza kind of chuckled and the director was a little upset about the picture. The director said tell them to take it off, so she returned to the class to find him still taped to the chair. She took the tape off with Ms. Fernandez's help. Due to inconsistent statements received, It is unknown who of the 3 individuals taped the child to the chair. Documentation must include the name of the affected party, date and time of the occurrence, description of the occurrence, actions taken and by whom, and appropriate signatures of program child care personnel and the custodial parent or legal guardian. Program child care personnel signatures may include the director/child care personnel that witnessed the incident, who were involved in the incident, and/or responded to the child's needs. The documentation must be maintained for 12 months. An accident/incident report was not written, complete and/or maintained.
