   2.8(A-B), and (F)(1-9), Handbook: The child care facility shall adopt a discipline policy consistent with Section 402.305(12), F.S., including standards that prohibit children from being subjected to discipline which is severe, humiliating, frightening, or associated with food, rest, or toileting. Spanking or any other form of physical punishment is prohibited. The child care facility operators, employees, and volunteers must comply with written disciplinary and expulsion policies. The following discipline techniques shall be prohibited in the child care facility: the use of corporal punishment/including, but not limited to: hitting, spanking, shaking, slapping, twisting, pulling, squeezing, or biting; demanding excessive physical exercise, excessive rest, or strenuous or bizarre postures; compelling a child to eat or have in his/her mouth soap, food, spices, or foreign substances; exposing a child to extremes temperature; rough or harsh handling of children, including but not limited to: lifting or jerking by one or both arms; pushing; forcing or restricting movement; lifting or moving by grasping clothing; covering a childs head; isolating a child in an adjacent room, hallway, closet, darkened area, play area, or any other area where the child cannot be seen or supervised; binding, tying or restrict movement, or taping the mouth; using or withholding food or beverages as a punishment; toilet learning/training methods that punish, demean, or humiliate a child; any form of emotional abuse, including rejecting, terrorizing, extended ignoring, isolating, or corrupting a child; any abuse or maltreatment of a child; abusive, profane, or sarcastic language or verbal abuse, threats, or derogatory remarks in front of the child or about the child or childs family; placing a child in a crib/portable crib for a time-out or for disciplinary reasons. A method of discipline was used that was inappropriate in that [a child was restained to a chair by placing the back of the chair inside the back of his shirt]. Ratios/Discipline [SR] Comments: Complaint alleges that, teacher A , physically restrains a child by pulling the back of his shirt over the chair to prevent him from moving in order to make my child complete activities and pay attention. Complaint also alleges that the same teacher yells at the children when they do not immediately follow instructions. She does not allow them to stand up and play freely. She tosses the toys onto the table for them to play with, and if they get up she yells at them to sit down. FINDINGS: A complaint inspection was conducted on 3/7/2025 and statements from the directors and teacher was received. Per the directors statements, the teacher told the parents that she did that when she was having a conversation with them. She did not intend to discipline the child, it was more to get him to do the work because he does not stay still. Directors stated that the parents love that teacher because she teaches the kids well. Per the teacher, she has been at the school for about 2 years. The child is very hyper and she tried this technique of putting the back of his shirt over the back of the chair to try to help him pay attention because it is hard for him to. She was working on teaching the children their colors and numbers and she wanted him to participate and learn as well. She stated that this was the only time she did this and she didn't do it to discipline the child because she even shared this information with the parents. With regards to the complaint about yelling and only allowing children to play with table toys, the teacher said that that is not true. She stated that in the mornings they do table toys, circle time on the carpet, free play and playground time. Children are not limited to sit at the tables all the time as mentioned on the allegation. This complaint is substantiated and a non-compliance is being issued for restricting movement by grasping clothing with the back of the chair. FACILITY/STORAGE 10.
