Sec. 7-33(e), Ordinance: There shall be at least one child care staff member providing direct supervision at all times when one or more children are present. At no time shall any children be left alone for any reason without direct supervision by a child care staff member. Direct supervision means watching and directing the childrens activities within close proximity in the same room or within a designated outdoor play area, and responding to each childs needs. Child care personnel and volunteers at a facility must be assigned to provide care to a specific group of children and be present with that group at all times during the day, including during meals, napping, and transportation of children 2.4.1(B), Handbook: Children must never be left inside or outside the facility, in a vehicle, or at a field trip location by themselves. Lack of direct supervision was observed in the [child left facility and was found walking at a park near the school]. Comments: Complaint alleges that On 12/3/2024, around 1:30 p.m. child P. R. DOB: 6/18/21 was observed walking in the park across from the school. Child (PR) started to walk towards the water then away from the water up the street and he kept walking as he was being followed by the walkers that found him. Child (PR) was about 5 blocks away from the school stating that he was trying to go home to his mom. The children were asleep in the school when Child (PR) woke up. Child (PR) was able to unlatch the dead bolt and exit out of the school. The Ring camera didn't trigger because it sits up high and Child (PR) was too small to trigger any motion. The weather was clear and sunny at about 74-75 degrees. The teachers were in the school and was unaware that Child (PR) had gotten out, they had the door locked, it is unknown how Child (PR) was able to get out. Child (PR) was returned back to the school. The lock sits pretty low with a deadbolt right above, that is easily in reach of the children. This happened right before the parents' pickup time. This is the first time known for this to have happened. A complaint inspection was conducted on 1/17/2025 and a statement from the Director (N. Damiani)was received. Per the director, the incident happened when they were putting the children to sleep. The 2y/o group is put to nap at 12PM. At 1PM, the 3y/o and 4y/o group are taken to the same room to nap. The child in question, P.R., is with the 3y/o group. At 1pm, he layed down on his mat/cot and she believed that he was asleep. She sat in the middle of the room on her laptop while the children napped. A little while later, doesn't know what time, the police came to knock om the door and asked her if she lost a child. She stated that she didn't but then the police showed her a picture of the boy. She thought that was a mistake and went to see if P.R. was paying on his cot. He was not on his cot and that is when she realized he was in fact missing. The police officer asked her to come with him to retrieve the child because he didn't want to get inside the police car. She went with him and they brought the child back to the school. They reviewed the cameras and the camera didn't pick up the child as he was not within camera view. The director stated that the door that led to outside where the child was sleeping was unlocked. It seems that the child managed to unlock the door and leave the school on his own. The parent was contacted but she didn't answer the phone. At pickup time, the mom was seen at pickup line and was asked to get off to speak. The parent mentioned that the child does that at home too and sometimes walks out into the garage. A walkthrough of the facility was done to check the room that the child was in. The child was sleeping in a small room that appeared to be the school lobby. The director was sitting at a table in the adjacent room, leaving about 4 children sleeping in this small room. This complaint is substantiated and a non-compliance and notice of violation is being issued. Provider was notified that a probationary license will be issued. 08.
