Child care personnel and volunteers at a facility must be assigned to provide care to a specific group of children and be present with that group at all times during the day, including during meals, napping, and transportation of children 2.4.1(B), Handbook: Children must never be left inside or outside the facility, in a vehicle, or at a field trip location by themselves. Lack of direct supervision was observed in the [playground]. Ratios/Discipline [SR] Comments: During the course of a complaint inspection conducted on 12/3/2024 the following non-compliance was observed; On 12/2/2024, the infant teacher was observed taking four infants out to the playground one or two at a time. The first child was left unsupervised as she retuned inside to get a second child. Then, two children were left unsupervised as she went back inside to retrieve the last two children. She left the infants alone a third time to retrieve a blanket. TA was given to the preschool about better transitioning into the playground. The director stated that she already informed the infant teacher to use the emergency crib to take them to the playground all at the same time. 08.    8.2(C), Handbook: Child care personnel must appropriately interact with children to foster a healthy, safe environment that will encourage the childs physical, intellectual, motor, and social development. Interactions with children that are aggressive, demeaning or intimidating in nature are strictly prohibited. Child care personnel inappropriately interacted with children in care in a manner that was aggressive, demeaning or intimidating in nature. Ratios/Discipline [SR] Comments: A complaint allegation was received alleging that CCLE licensing specialist J. Thyme was conducting a routine inspection at near by facility and overheard a scream/cry for help from a young child. Upon hearing the loud noise coming from across the street, the CCLE specialist (J. Thyme) witnessed an infant 11 months, being restrained by a teacher. The child was picked up and roughly put onto the ground and the staff member continued to hold the child down roughly. J. Thyme. (CCLE) then approached the director regarding what she witnessed and reported to her that the Child Abuse Hotline will be notified and that the parent would need to be called. The facility director did move the teacher to another class. The facility will be providing CCLE with the recorded video. Staff member's name is J. Alcantara-Marquez and the child's name is A.L. A complaint inspection was conducted by CCLE Chief Complaint Investigator who collected statements from the director and office administrator. A video of the alleged incident was also reviewed and recorded for inspection documentation. The following was observed on the video recording: The teacher was taking the children out to the playground. She took out a baby on a bouncy seat, placed him/her near the left side of the playground and went back inside the classroom to retrieve a second child. The second child was the baby in question (AL). Then, she went back inside to retrieve the third and fourth child, one in each arm. After placing the last two children on the floor, she picked up AL and moved her over from the sidewalk onto the grass turf causing her socks to fall off. Then she went back inside, came out again to find that AL had crawled back on the sidewalk. She picked her up in a rough manner, and carried her to the left side of the playground. As she is walking away from the camera, her left hand can be seen to move up with an open palm and move down fast toward the child , as if she were to have swat the child. She sits down , facing the camera and swats the child two more times, using her right hand. She puts the child's sock back on and sits the child next to her. At this point, the child can clearly be seen crying as her face was facing the camera. The child leaned her head on the blanket that the teacher placed on the floor so the teacher pulled her down by one arm and started patting her back. The child is seen laying down on the blanket when J. Thyme made contact with the teacher. The teacher then sat the baby up while speaking with inspector J. Thyme. Video of the classroom prior to going to the playground was reviewed and the teacher was observed changing a diaper. Then, she was observed playing with AL as she sat on a baby bouncer gym. She played with her, gave her a kiss, and a hug prior to going out to the playground. It is uncertain if the child was already crying prior to going out to the playground. This complaint is Substantiated as the teacher's interaction with the baby while on the playground was aggressive in nature. A non- compliance is being issued. FACILITY/STORAGE 10. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [see below:]. Ratios/Discipline [SR] Comments: A complaint allegation was received alleging that, Mr J. Davila pick up child S. from the daycare, she had bites marks and bruises on her left arm begging from the top of the palm all the way around and to the top of elbow (front and back) also she had a bit mark on her cheek. Bruises on her nose, top of the lip, bottom of the lip. Skin tear near the bottom of her left eye. Her right eye was red at the bottom. When he asked for an explanation all 3 teachers gave to him different answers. The director was not at the facility. We went today to speak to the director regarding to what had happened because nobody gave us an explanation and to check on the surveillance camera and the director told us that the cameras are live streaming so they have no way to look back to what had happened and after interview the teachers she basically told us that child S. had been bitten on the playground by another child under there care but they didn't notice anything on her arm when the lesions are very noticeable. So basically they told us that nobody notice or knew what was going on till the time of pick up. Also they didn't show us the surveillance camera. This is child neglect and abuse from the facility and the staff involved. Findings: A complaint inspection was conducted on October 17, 2024, and the statement from the director (M. Santana) and teacher (S. Arias) were received. Per the director, she was not at the center at the time the incident happened she did not deny that the child S was injured by child K during the outdoor time under the care and supervision of two staff members. She also explained that yes, the incident happened, and staff members did not notice the interaction of the two babies. She explained that the child S came crying from behind one of the play structures, the teacher S. Arias pick up the child S and only notice the bites marks on her face, she embraces the child, but no action was taken, she did not search to ensure that the child was okay. Returning from the playground during the dipper changing the other teacher Ms. S. Lopez saw the multiples bites mark on child S. This complaint is Substantiated. 09. Facility/Storage [SR] Comments: On October 14.2024 Childcare Licensing received a complaint alleging multiple bites marks and bruising on left arm, top of palm to elbow front and back, and bottom of lip and left eye. During the onsite investigation visit on October 17, 2024, the following corrective action was completed at the time of the Complaint visit: Two broken play structure, one with rusty and sharp screws exposed/protruding was accessible to the children.
