21. Outdoor Play Space Group: Sec. 7-37, Ordinance and DCF Handbook (21-11)

3.5(F), Handbook: The outdoor play area must have adequate fencing or walls a minimum of 4 feet in height. Fencing, including gates, must be continuous and must not have gaps or opening larger than 3 inches that would allow children to exit the outdoor play area. The base of the fence must remain at ground level, and be free from erosion or build-up to prevent inside and outside access by children or animals. These areas must have at least two exits, with at least one being remote from the buildings. If an outdoor play area was approved for usage by the Department prior to October 25, 2017, no new exits are required to be added to meet this standard. However, if outdoor play area fencing is changed then the standard would apply and two exits must be provided. The facilitys fencing was inadequate in that [see below]. Sec. 402.305(4)(a), Florida Statutes: Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. A ratio of [1] child care personnel for [4] children is required. A ratio of [1] child care personnel for [5] children was observed. Ratios/Discipline [SR] Comments: The following ratios were observed during todays visit: Infant: 1:5 1 yr old: 2:12 2 yr old: 1:10 3-4yr old: 1:11 School age: 1:8 Upon arrival the infant classroom was observed to be out of ratio. Sec. 7-30(c), Ordinance: All staff members of child care facilities must have a high school diploma or the equivalent. A high school diploma or equivalent was not on file for all staff members. Comments: There were 2 staff members without proof of education in their file. 3.1(A), Handbook: All child care facilities must be clean, in good repair, free from health and safety hazards and from evidence of, or presence of, vermin infestation. An area(s) of the facility was observed to not be in good repair. Facility/Storage [SR] Comments: During a complaint investigation in April a number of areas not in repair were noted on the report. The following items were repaired; the outdoor water fountain was observed in working order today. The broken tiles in the toddler room have been replaced. The loose and broken chairs have been replaced the door frame in the 3 year old classroom has been cleaned. During today's inspection the following repairs were noted: front desk counter border peeling causing rough edges (this was noted during the complaint investigation and has not been corrected) all thresholds leading to outdoor play space were observed to be dirty there are floor tiles in the toddler and preschool classrooms that are starting to crack and should watched climbing structure on outdoor play space was dirty inside the structure (on the floor was mulch and dirt and the structure itself was dirty Source: FL DCF CARES inspection 2025-06-12. Sec. 7-33(c)(2), Ordinance: In groups where children of varying ages are combined, the staff-to-children ratio shall be based on the youngest child in the group. A staff-to-child ratio of [see below ] staff for [see below] children was observed Comments: During a complaint investigation related to ratio it was noted that the facility was out of ratio when the group of children had varying ages early in the morning. During todays inspection a review of the early morning attendance sheet showed that at 7:37 am this morning there was a total of 12 children of mixed ages (0-4) with two teachers. The health assessment statement shall be documented on a form prescribed by the local licensing agency and updated at least every two years. Child Care personnel did not have a current health statement on file. Sec. 7-33(c)(2), Ordinance: In groups where children of varying ages are combined, the staff-to-children ratio shall be based on the youngest child in the group. A staff-to-child ratio of [1] staff for [11] children was observed Comments: Complaint alleges that there are only two teachers that open the school in the mornings, one in the infant room and one in the toddler room and rooms are out of ratio. At times, the toddler teacher has had about 22 children under her care. This morning's face to name attendance was checked for compliance and the following was observed; - Two teachers were at the school from 6:30AM to 7:45AM. There were a total of 15 children of mixed ages (1 to 9) with the two teachers by 7:36AM, prior to the arrival of the third staff member. This complaint is substantiated. Today's ratios were as follows: Infants 2:8, 1y/o 1:6, 1y/o and 2y/o 1:11, 2y/o and 3y/o 1:10, 4y/o and 5y/o 1:11 Ratio in the 2y/o room was out of compliance; there were ten 2y/o children and one 1y/o child with one teacher. TA was provided that minimum ratios must be followed at all times. Director stated that a teacher called out today and they are in the process of hiring another staff member. 6, Handbook: Personnel are required to be educated on the facilitys exposure plan regarding standard precautions before beginning to work and annually thereafter. Written documentation that child care personnel have participated in the facilitys annual refresher education for the exposure plan and understand the proper procedures in the event there is exposure to blood and potentially infectious fluids must be retained for 12 months and be available for licensing to review. The facility does not have documentation for all child care personnel on required annual refresher education of the facility's exposure plan. (Section 2.1(A) Health and Safety, Page 3) Health Program [SR] Comments: During the routine #2 inspection it was noted that the staff had not completed an annual refresher for the facilities exposure plan. 3.11(A), Handbook: A child care facility must make available toys, equipment, and furnishings suitable to each childs age and development and of a quantity for each to be involved in activities. The toys/equipment/furnishings in the [toddler and two year old classrooms.] are not sufficient for the number of the children using the classroom. (Section 2.1(A) Health and Safety, Page 3) Indoor/Outdoor Space [SR] Comments: At the time of this inspection it was noted that there were not materials in housekeeping, blocks, and , table toys in these classrooms. It was also noted that the amount of materials in the art area and in other areas were not sufficient for the number of children using the classroom. According to staff materials have been added to these room but the children are not taking care the items. so broken items are being discarded. It is suggested that plastic storage bins with lids be added to these classroom to store materials and teachers supervisor play so that materials are used appropriately. 18. Sec. 7-30(a)(2), Ordinance: All child care personnel permanently assigned to care for infants (i.e., children under one year of age) must have completed or complete within 90 days after such assignment the Infant and Toddler Appropriate Practices module from Part II of the DCF child care training. The facility did not have documentation to show completion of infant/toddler training for all child care personnel assigned to working with infants. Comments: Technical assistance was given during the Routine #2 inspection regarding the two staff in the infant room completed the Infant Toddler Appropriate Practices module from Part II of the DCF child care training. At the time of this inspection there was no documentation to show that one of the staff in the infant room had completed the infant/toddler training. Facility is reminded that this training can be completed for in-service hours as the staff person has already me the requirements for the DCF 40 hour training. 04.
