6, Handbook: Personnel are required to be educated on the facilitys exposure plan regarding standard precautions before beginning to work and annually thereafter. Written documentation that child care personnel have participated in the facilitys annual refresher education for the exposure plan and understand the proper procedures in the event there is exposure to blood and potentially infectious fluids must be retained for 12 months and be available for licensing to review. The facility does not have documentation for all child care personnel on required annual refresher education of the facility's exposure plan. Sec. 7-33(e), Ordinance: There shall be at least one child care staff member providing direct supervision at all times when one or more children are present. At no time shall any children be left alone for any reason without direct supervision by a child care staff member. Direct supervision means watching and directing the childrens activities within close proximity in the same room or within a designated outdoor play area, and responding to each childs needs. Child care personnel and volunteers at a facility must be assigned to provide care to a specific group of children and be present with that group at all times during the day, including during meals, napping, and transportation of children 2.4.1(B), Handbook: Children must never be left inside or outside the facility, in a vehicle, or at a field trip location by themselves. Lack of direct supervision occurred when [the facility did not respond to the child's complaints about the shirt]. Ratios/Discipline [SR] Comments: During the course of a complaint inspection, the school was determined to have lacked adequate supervision of a child that received severe chemical burns from a shirt provided by the school. FINDINGS: Per the VPK teachers, the shirt was changed at 10:00AM and the child remained with the shirt on until parent arrived to pick up after 5:00PM. The aftercare teacher stated that the child requested to change her shirt on numerous occasions but the teacher did not investigate further the reason for the child's discomfort. After 4:15PM, the aftercare teacher took the class to the playground. Once in the playground, CB told her several times that she wanted to change her shirt. At that point, the teacher saw the child's chest, below her clavicle, to the right, and a discoloration to her skin caught her attention. She pulled the child's collar open and saw the brown color on the child's skin. She asked the child what happened and the child would not speak because she was crying. The aftercare teacher called the director, who then went to the playground to look at the child and attempted to call the parent. The child remained with the group until parent arrived to pick her up a little after 5PM. Per the accident/incident report, at 2:40PM, the child was crying and when the aftercare teacher asked her "what happened?", the child said she wanted to change her shirt. She didn't have another shirt in her cubby. Later, the teacher noticed something on her neck and reported it to the office. The child's needs were not met in this instance, therefore, causing the child to be exposed to the chemical on the shirt for over 6 hours. 3.2(A), Handbook: All areas and surfaces accessible to children must be free from toxic substances, bio contaminants, and hazardous materials/equipment/tools, including power tools, plastic bags, matches, candles, lighters, etc. A toxic/hazardous material was accessible to children. Facility/Storage [SR] Comments: A complaint allegation was received alleging that on Friday 12/05/2025 at 4:59 PM, the school contacted the mom and said that the child was whining all day after they changed her shirt at around 10am. Parent asked to speak with her daughter and the child said "she had scratched herself. Parent arrived at the school at 5:06 PM. When parent arrived, she noticed that the child's neck and shoulder were darkened. Parent took child to Memorial West at about 5:20 PM. The nurse/doctor told parent it looked like an abrasion or possibly a bruise and that it would go away. However, around 2 AM the next day, the area started to blister. Parent and child returned to Memorial, and this time they said it was a chemical burn. They advised her to go to the daycare on Monday to get an incident report. Parent took child to Joe DiMaggio Childrens Hospital on 12/8/2025 and they diagnosed CB with a third-degree burn and transferred her to Jackson. Parent was told by staff at memorial west that the clothes CB was wearing had chemicals on them. The child told parent that when they changed her clothes, it was itching and hurting all day, and they said she was whining. FINDINGS: A complaint inspection was initiated on 12/11/2025 and completed on 12/15/2025. Statements from the following staff were received: VPK Teachers (C. Coen, E. Medina,) and aftercare teacher (N. Castro). PLEASE REFER TO STATEMENTS ON COMPLAINT FORM. The school is being cited because the child was injured due to a stained shirt that caused a severe burn on her skin. A notice of violation is being issued and the non-compliance is being escalated to a class 1. This documentation must be shared with the custodial parent or legal guardian on the date of occurrence. If the parent or legal guardian does not pick up the child on the date of occurrence of the accident or incident, the individual authorized to pick up the child must sign and be provided a copy of the accident/incident form. Documentation of an accident/incident was not provided on the day it occurred. Childrens Records [SR] Comments: Complaint alleges that on Monday 12/8/2025, mom went to the daycare and asked for the incident report with details as of why her childs shirt was changed. At 6:15 PM, the daycare staff created a report stating that the child had an allergic reaction and suggested that the parent may have been taking child to her primary care physician. The director later gave her two incident reports dated the 5th, but none of the information matches what happened. FINDNINGS: A complaint inspection was initiated on 12/11/2025 and completed on 12/16/2025. Per the Director, the report was given to the parent on the date that the incident took place and the parent refused to sign it. The report documented what they believed was happening to the child. The school staff did not know that the child had suffered a burn from the shirt that they put on her. After further review, the accident/incident report that was shared with the parent on the date of occurrence was the report documenting that the child cut her shirt. The second incident report documenting that the child was crying, saying that she wanted to change her shirt, and that the teacher noticed an inflamed area on her neck was not written, nor given to the parent until 12/8/2025. This complaint is substantiated as all accidents and incidents or unusual occurrences that are threatening to the health, safety, or welfare of a child that occur while the child is in care must be documented on the same day they occur.
