11. Toxins/Hazardous Materials Group: Sec. 7-42, Ordinance and DCF Handbook (11-02)

3.2(A), Handbook: All areas and surfaces accessible to children must be free from toxic substances, bio contaminants, and hazardous materials/equipment/tools, including power tools, plastic bags, matches, candles, lighters, etc. A toxic/hazardous material was accessible to children. Facility/Storage [SR] Comments: Upon arriving to the program, a crane was observed in front of the facility placing an AC unit on top of the facilitys roof. The entrance/exit and indoor area directly under the placement of the AC unit were not secured for children present at the time of the inspection. Hazardous equipment/tools were being used while children attending the program. Provider decided to stop conducting work in the roof area while children present. Therefore, this area was brought back into compliance during todays visit. Technical assistance was provided regarding conducting major repairs when children present. 6.4(A), (B) and (D), Handbook: All accidents and incidents or unusual occurrences that are threatening to the health, safety, or welfare of a child that occur while the child is in care must be documented on the same day they occur. This documentation must be shared with the custodial parent or legal guardian on the date of occurrence. If the parent or legal guardian does not pick up the child on the date of occurrence of the accident or incident, the individual authorized to pick up the child must sign and be provided a copy of the accident/incident form. Documentation of an accident/incident was not provided on the day it occurred. Childrens Records [SR] Comments: Complaint alleges that J.M. (DOB 07/15/2025) suffering an accident at provider. At pickup time, on Monday 03/02/2026 at 6:00 pm, the provider asked person picking up to sign an incident form stating J.M. had fell down and hurt his head. The school stated that the child was just standing and fell. Mom immediately took J.M. to the Emergency Room. J.M. suffered a bruise on his head due to the accident. J.M. has had 6 other incidents including this one. The school never provided a copy of any of the incident reports to client. FINDINGS: A complaint inspection was conducted on 3/9/202 and statements from the teachers (L.P. and A.P.) were received. Per the teachers, the child was playing on the carpet with one of the teachers (L.P) and a few other infants and the second teacher (A.P.) was feeding another infant. At the time of the incident, L.P. was siting on the carpet, tending to/playing with 2 other babies when J.M. fell and hit his forehead. Ms. L.P. heard the bump and tended to the baby but he didnt cry nor show any sign of discomfort. Ms. A.P. provided a cold wipe that was applied on his forehead to prevent swelling. He was behaving normally after the incident. Shortly after, he left for the day. Per the assistant director, an accident/incident report was created but a copy was not give to the uncle who picked up the child. An attempt to contact the mom was made but the phone lines were down and connection couldnt be made prior to the child being picked up. The child was fine but it is the schools practice to call the parents when an incident occurs. Other incident reports on file were dated 2/12/26(hit on right side of forehead on chair), 2/19/26(hit his forehead on shelf), 3/2/26 (forehead bruise, trying to stand up and fell), 2/26/26 (hit face on toy). All accident reports written and signature received from parent/person picking up. On 3/2/26 the parent was not he person that picked up J.M.. The person picking up the child signed the report but a copy was not provided for him to take to the parent. Classroom was in ratio; 2 child care personnel with 6 infants. This complaint is partly substantiated, even though the report was written and signed by the person picking up, a copy was not provided. 41. Sec. 7-4.06(c), Ordinance:Direct supervision means watching and directing the childrens activities within close proximity within the same room inside or within a designated outdoor play area and responding to each childs needs. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [Child slipped on a book]. Ratios/Discipline [SR] Comments: During the course of a complaint inspection where a child (IQ) received an injury to his left leg, the video of the incident was reviewed and the following was observed; Video footage of the incident was observed and date and time as described on the video name was 9/6/2024 at 8:40AM. The child was observed walking by the bookshelf. He tried to take a side step and put his foot on top of a book that was laying on the floor. The book slid the opposite direction of his body causing him to do a split. He started crying and repositioned his body into a sitting position. Two staff members were observed in the room. One staff member had her back toward the child and the other had her side toward the child. None of them saw what happened and one of them (Ms. JC) turned around to assist the child. She bent down, hugged him, picked him and took him away from camera view. Although there were two staff members in the classroom, Inadequate supervision occurred in that the staff members were observed standing together and appeared to be engaging in a conversation with someone off camera view not watching and directing the children's activities. 09.
