A ratio of [1] child care personnel for [6] children is required. A ratio of [1] child care personnel for [7] children was observed. s.402.305(4), F.S. (Section 2.1 Health and Safety, Page 3) General Requirements [SR] Comments: Ratio Observed at Time of Inspection: Room #1 One-year-olds: 1:7 Room #2 Four-year-olds: 1:13 Room #3 Three-year-olds: 1:12 During the inspection, the Licensing Specialist observed that Room #1 was out of compliance with the required staff-to-child ratio, as one staff member was supervising seven (7) one-year-old children, exceeding the maximum allowable ratio for that age group. The Licensing Specialist provided technical assistance to the Director regarding section 402.305(4), Florida Statutes, and the Florida Child Care Facility Handbook, which establish the required staff-to-child ratios and mandate that these ratios be maintained at all times while children are in care. Specifically, the required ratio for one-year-old children is one (1) staff member for every six (6) children (1:6). The operator is responsible for ensuring that minimum staffing requirements are met based on the ages and number of children present. The Licensing Specialist immediately discussed the deficiency with the Director. As a corrective action, one child was relocated from Room #1 to Room #3, restoring compliance with the required staff-to-child ratio during the inspection. Child records or copies of records were not being maintained at the facility and available for review by the licensing authority. CCF Handbook, Section 7.3, A (Section 2.1 Health and Safety, Page 3) Record Keeping [SR] Comments: During the inspection, the Licensing Specialist observed that a staff members children were present in the classroom and receiving care while the staff member was performing assigned job duties. The facility failed to maintain completed enrollment records for these children. Because the children were receiving care without the required enrollment documentation on file, the facility was determined to be out of compliance with Section 7.3, Enrollment Information, of the Florida Child Care Facility Handbook. The Licensing Specialist provided technical assistance regarding Section 7.3 Enrollment Information of the Florida Child Care Facility Handbook. The provider was advised that enrollment information must be obtained from the childs custodial parent or legal guardian prior to accepting a child into care and must be maintained on file, current, and available for review by the licensing authority. The provider was further advised that any child receiving care within the facility, including a staff members child, must have a completed enrollment record in accordance with handbook requirements. The Florida Child Care Facility Handbook states the following in 7.3: The facility operator shall obtain enrollment information from the childs custodial parent or legal guardian prior to accepting a child in care. This information shall be documented on CF-FSP Form 5219, Child Care Application for Enrollment, or an equivalent form that contains all the information required by the Department on CF-FSP Form 5219. Additionally, Section 7.3(A) states: Enrollment information shall be kept on file, current and available for review by the licensing authority. Corrective Action: The staff member arranged for the children to be picked up from the childcare facility during the inspection. As a result, the children were no longer receiving care without the required enrollment documentation, and the facility was returned to compliance at the time of the inspection. Therefore, this standard was resolved. Compliance Comments The Licensing Specialist all staff/employee personnel records on-site, a total of (7) staff/employee files. The Licensing Specialist observed that personnel records were maintained and current on all childcare personnel, totaling (7) employees/staff. CCF Handbook, Section 7, B.4 (Section 2.1 Health and Safety, Page 3) Record Keeping [SR] Comments: During the inspection, the Licensing Specialist observed that the classrooms did not have current daily attendance records available. The Licensing Specialist spoke with the Director regarding this deficiency and requested that each classroom provide its daily attendance documentation. Technical Assistance (TA): Technical Assistance was provided regarding the requirements of the Florida Child Care Facility Handbook, which states that a daily attendance record must be maintained to accurately account for all children in care and must be kept current throughout the day. Attendance records must be maintained in a manner that is readily available for review by the licensing authority. Because the classrooms did not have current daily attendance records available at the time of the inspection, this standard was determined to be out of compliance. Corrective Action Plan: The Licensing Specialist instructed the Director to ensure that each classroom maintains an accurate and up-to-date daily attendance record at all times while children are in care. The Director was advised to implement procedures to verify that attendance is documented upon each childs arrival and departure and that classroom staff maintain the records throughout the operating day. The Director immediately addressed the deficiency by directing staff in each classroom to complete and provide the required daily attendance records. Prior to the conclusion of the inspection, the Licensing Specialist verified that the classrooms had updated daily attendance records in place, bringing the facility back into compliance with the requirements of the Florida Child Care Facility Handbook.
