33. Training Requirements CCF Handbook, Section 4 (33-05)
Child Care personnel, who were not in compliance with training requirements when they left the industry, did not complete required training and any new mandated training before returning to the industry. CCF Handbook, Section 4.3, B Comments: Specialist observed a personnel K.L who had started the industry in 2.20.24 and left in 2.15.2025. The personnel had not completed her 45 hours training within the first year of employment. K.L had returned 3.21.2025 and still had not had completed the 45 hour training. 4.3 Break in Service [...] B. In the event an individual leaves the child care industry not in compliance with the training requirements and returns to the industry either at the same or a different child care facility, he or she must comply with the training requirements described in this section, as well as any new training requirements that may have been added during the gap in employment in the child care industry prior to re- employment. Facility made the decision to terminate K.L until her training is completed, resolving at time of inspection. 45. Background Screening Documents CCF Handbook, Section 7.4.1 (45-03)
The personnel record for the individual indicated the person had been arrested for and are awaiting final disposition of, have been found guilty of, regardless of adjudication, or entered a plea of nolo contendere or guilty to any offense noted in Section 435.04, Florida Statute, which disqualifies the person from employment and the owner/operator failed to take appropriate action in that [an individual was hired, selected, or otherwise allowed to have contact with vulnerable persons without an eligible Level II screening].s 435.04 F.S. Comments: The investigation revealed that the program hired an individual for the role of Teacher's Assistant despite the individual having a disqualified BGS. The individual listed on the Supplemental Inspection Sheet was hired for training on 11/12/2025; while training, the individual was allowed access to the children in the child care program. The individual was employed for 27 days before their resignation on January 4, 2025. For the duration of the individual's employment, their BGS remained in the not eligible status. Though the individual was going through the Exemption from Disqualification process for BGS, they were not eligible for employment during the appeal process. It was noted during the investigation that the individual was never permitted to be alone or have unsupervised contact with children. The standard was brought back into compliance when the disqualified individual resigned from the program; completed at time of inspection. Technical assistance was provided regarding the importance of ensuring all personnel have the appropriate Level II BGS prior to having contact with vulnerable persons. Level II BGS standards are established in s. 435.04, F.S. and if the employee has a disqualifying offense per s. 435.06(2)(a), F.S., then they are not eligible for hire. According to s. 435.06(2)(a): "An employer may not hire, select, or otherwise allow an employee to have contact with any vulnerable person that would place the employee in a role that requires background screening until the screening process is completed and demonstrates the absence of any grounds for the denial or termination of employment. If the screening process shows any grounds for the denial or termination of employment, the employer may not hire, select, or otherwise allow the employee to have contact with any vulnerable person that would place the employee in a role that requires background screening unless the employee is granted an exemption for the disqualification by the agency as provided under s. 435.07." 46. Access/Child Safety CCF Handbook, Section 8 Not Monitored Owner/Director/Staff Responsible Comments At Melrose Preschool, the safety and well-being of our children is always our highest priority. We recently had an employee with us for less than a month who was recommended by a trusted school family and is a loved member of our community. While she was in the classroom with the children as part of her training, she was never left alone with them. When she was in a classroom, she worked closely with one of our Owners and one of our long-time employees. We were under the impression that she was permitted to be on- site for training purposes, though not to provide unsupervised care. Her responsibilities included supporting teachers, assisting with office work, cleaning the kitchen, and preparing snacks. Wed also like to note that the employee has since appealed the findings of her background screening and successfully overturned the decision, officially clearing her to work directly with children. Our administrative team works diligently to ensure all documentation and procedures are in compliance with DCF guidelines. We sincerely apologize for this oversight and remain fully committed to upholding the highest standards of care and safety.
