A ratio of [2] child care personnel for [20] children is required. A ratio of [1] child care personnel for [20] children was observed. s.402.305(4), F.S. General Requirements [SR] Comments: Specialist observed the following ratio; Classroom A with 10 infants to 3 personnel Classroom B with 12 infants to 3 personnel Classroom C with 11 one-year olds to 2 personnel Classroom D with 10 one-year olds to 2 personnel Classroom E with 12 one-year olds to 2 personnel Classroom F with 11 two-year olds to 1 personnel Classroom G with 20 four-year olds to 1 personnel Classroom H with 20 two-year olds to 2 personnel Classroom I with 20 children; 10 three-year olds and 8 four-year olds, and 2 five-year olds to 1 personnel Because the majority of children present are three-year olds, the classroom should be at a ratio of 1 personnel to 15 children. An additional staff member was brought into the classroom to come back into compliance. Technical assistance was provided regarding mixed age ratios. The child care facility operators, employees, and volunteers must comply with written disciplinary and expulsion policies. Personnel was terminated as of 7/28/25. Child care personnel misrepresented information, impersonated, or provided fraudulent information related to the child care facility to a parent/guardian, licensing authority, or law enforcement. s. 402.319(1)(f), F.S. Enforcement [SR] Comments: Specialist observed, while adding in new personnel, E.P a CPR card that appeared to be photocopied and altered. The CPR class showed a date that was not consistent with the employee's hire date. The specialist reached out to the CPR instructor and confirmed that the personnel had not participated in the course. Technical assistance was provided from s. 402.319(1)(f), F.S., 402.319 Penalties (1) It is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083, for any person knowingly to: (f) Make any other misrepresentation, by act or omission, regarding the licensure or operation of a child care facility or family day care home to a parent or guardian who has a child placed in the facility or is inquiring as to placing a child in the facility, or to a representative of the licensing authority, or to a representative of a law enforcement agency, including, but not limited to, any misrepresentation as to: The number of children at the child care facility or the family day care home; 1. The part of the child care facility or family day care home designated for child care; 2. The qualifications or credentials of child care personnel; 3. Whether a family day care home or child care facility complies with the screening requirements of s. 402.305; or 4. Whether child care personnel have the training as required by s. 402.305. 5. Child care personnel misrepresented information, impersonated, or provided fraudulent information related to the child care facility to a parent/guardian, licensing authority, or law enforcement. s. 402.319(1)(f), F.S. (Section 2.1 Health and Safety, Page 3) Enforcement [SR] Comments: While reviewing driver's physicals, licensing supervisor observed one physical with falsified dates. The dates were modified by covering the original digits of the year that the driver's physical was conducted with white out and writing in the current year (2024). Licensing supervisor was able to feel the white out physically as well as observe it. Due to the white out/falsification, the original year that driver EH had a driver's physical conducted is unknown. EH was confirmed via transportation logs provided by the facility to be the driver of one of the buses on 10/5/24. Technical assistance was provided from s. 402.319(1)(f), F.S., which states: 402.319 Penalties (1) It is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083, for any person knowingly to: (f) Make any other misrepresentation, by act or omission, regarding the licensure or operation of a child care facility or family day care home to a parent or guardian who has a child placed in the facility or is inquiring as to placing a child in the facility, or to a representative of the licensing authority, or to a representative of a law enforcement agency, including, but not limited to, any misrepresentation as to: 1. Whether child care personnel have the training as required by s. 402.305. Provider must have driver EH complete a driver's physical exam prior to driving any of the buses.
