On three separate instances on March 10, 2026, Staff A roughly handled a 2-year-old child. 1.Staff A grabbed Child 1 under one arm, pulling the child off her feet. 2.Staff A grabbed Child 1 by the wrist and knee, lifting her off her off the floor. 3.Staff A removed Child 1 from an indoor climbing structure and roughly released her onto the cot.

Behavioral guidance shall be constructive in nature, age and stage appropriate and intended to redirect children to appropriate behavior. When two-year-old Child 1 did not stay on the cot during the designated rest period, Staff A abruptly grabbed the child by the wrist and knee, lifting her off the floor and onto the cot. Approximately two minutes later Staff A removed the child from the cot and took her to a corner telling the child to stand right there. Child 1 was in the corner crying, for approximately five minutes.

In a preschool classroom there were 4 finger width holes in the wall within reach of children, and a tear on a diaper changing pad.

Where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 The poured-in-place resilient surfacing on the preschool playground near the slide is cracked and raised where a tree root has grown underneath. The poured in place near the slide and the steps is cracked and a layer of the resilient surfacing has peeled off. On the preschool two's playground the poured in place at the exit of the slide chute is hard, cracked and has holes where a repair had been made.
