R381-100-7(9)(a)-(g) — Caregiver requirements

The provider was out of compliance with R381-100-7(9)(b) by not ensuring that all caregivers completed the preservice training offered by the department, At the time of the inspection, 2 caregivers had not completed the requisite training. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On June 17, 2025, the licensor verified that the provider had all caregivers complete the preservice training offered by the department, as stated in rule.

R381-100-11(1)(a)-(f) — Provide and maintain active supervision

The licensee was out of compliance with R381-100-11(1)(a) by failing to provide direct supervision to every child in care. During an inspection, it was determined that 3 children were found unsupervised in their classroom bathroom, which resulted in their acting out sexually inappropriately with each other. Inspection: Complaint, Investigation Inspection, Focus Inspection. Correction status: Manager approval, no follow up needed. Correction action: On April 17, 2025, the licensor verified that the licensee re-trained all staff on supervision procedures, as required by rule.

R381-100-6(3) — No conduct adverse to children allowed

The provider was out of compliance with this rule by having a caregiver whose interactions toward the children in their care endangered the children in their care. In the facility, video footage from the toddler classroom showed a caregiver being physically aggressive and verbally aggressive with the children in their care. Inspection: Complaint, Investigation Inspection. Correction status: Correction Verified. Correction action: On 12/13/2024, the licensor verified that the provider ensured that no caregiver would conduct themselves in a way that endangered children as stated in rule.

R381-100-12(5)(a)-(f) — Interactions with children

The provider was out of compliance with this rule by having a caregiver who had inappropriate interactions with the children in care. In the toddler classroom, the caregiver was observed on video being physically aggressive with a child in care. Inspection: Complaint, Investigation Inspection. Correction status: Correction Verified. Correction action: On 12/13/2024, the licensor verified that the provider would ensure that interactions with children did not include corporal punishment or emotional abuse as stated in rule.
