Staff assigned to specific children (3270.113(a)(1))

At approximately 3:15pm on 4/13/26 video footage taken at the facility shows Staff #1 and Staff #2 entering the California classroom to drop off water bottles. At that time, Child #1 enters the bathroom. After the class lines up to leave, Staff #2 enters the bathroom to check for children. Staff #1 and Staff #2 then exit the California classroom with the line of children. Approximately a minute and a half later Child #1 is seen exiting the bathroom. A parent picking up their child enters the room to gather belongings and Child #1 exits the classroom with the parent. Staff #3 was right outside the doorway and took Child #1 to rejoin the group. Requirement: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. Correction: Staff #3 returned Child #1 to the class group and made sure Staff #2 was aware the child was joining and had been assigned to their group. Both staff listed their group and were aware that each staff person is assigned the responsibility for supervision of specific children. Staff were reminded they need to know the names of children assigned to them, know their whereabouts, and be physically present with those children while on facility premises. Supervised at all times (3270.113(a))

Staff #1 and #2 were spoken to directly about the incident and the family of Child #1 was notified of the incident. On 4/14/26, Staff #1 and #2 were written up for lack of supervision, were shown camera footage of the incident, and were shown the name to face report. Our supervision policy was reviewed so that children on the facility premises will be supervised by a staff person at all times. Inspection: Self-Reported Non Compliance. Written consent/Consent for emergency medical care required prior to admission (3270.124(b)(4)/3270.182(3))

The Emergency Contact Form in the file for Child #1 lacked written consent signed by a parent for emergency medical care. Requirement: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission. Correction: The parent of Child #1 has update the emergency contact information and provided signed written consent for emergency medical care. Inspection: Renewal. Clean and good repair (3270.102(a))

In the Michigan Classroom a doll cradle was observed to be broken as the bottom had become detached creating a pinching hazard to the children in care. In the Outdoor Small Grassy Area, a cracked purple gate was observed posing a cutting hazard to the children in care. Requirement: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. Correction: Both broken items were immediately removed from the childcare space and discarded, so that remaining items were all in good repair. Inspection: Renewal. In child care spaces (3270.75(a))

A staff person and four children from the Texas Classroom left the classroom with the first aid kit to go on a walk, leaving a second staff person with three children in the classroom without a first aid kit in the childcare space. Requirement: A first-aid kit shall be in a child care space. Correction: A second first aid kit was made for the Texas classroom and will be kept inside the classroom childcare space at all times. Comply with CPSL/CPSL information (3270.32(a)/3270.192(4))

Although the files for Staff #1 and #3 contained current National Sex Offender Certificate at the time of Renewal Inspection, it was observed that Staff #1 and #3 did not obtain their National Sex Offender Certificate within 60 months of the previous clearance. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Correction: Renewed clearances are already in the employee files for staff #1 and staff #3. Staff #1(results received late) and #3(missed the deadline to renew) were removed from the schedule until their renewed National Sex Offender Certificate were received. Inspection: Renewal. Health and Safety Training (3270.31(f))

Staff person #2 has completed Pediatric first aid and CPR training, however the training was not completed through a Pennsylvania Quality Assurance System (PQAS) approved curriculum. Requirement: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility. Correction: Until staff person #2 completes Pediatric First Aid and CPR training through a PQAS approved curriculum, she will be supervised by an AGS or GS that has completed their preservice trainings and meets all of the qualifications to care for children unsupervised anytime she is interacting with children. If unable to be supervised, staff person #2 will not be placed in a childcare role. Staff person #2 will be completing the course during our in-service day in February. Inspection: Renewal. 12 months prior to service and every 24 months thereafter (3270.151(a))

The last two Health Assessments in the files for Staff Person #4 and #5 were dated more than 24 months apart. Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. Correction: Updated health assessments for Staff person #4 and #5 were already on file. Both staff members were removed from the schedule immediately and were sent to receive a health assessment immediately when we became aware that the requirement was past due. Inspection: Renewal. Exceeding Capacity (3270.61(h))

At 10:30 AM, 18 children were observed in the middle preschool structure play space that has a designated maximum capacity of 15. Requirement: The capacity established for an indoor space may not be exceeded except in situations described in § 3270.61(h)(1-3) Correction: Teachers were advised/reminded to split their groups when using the playgrounds if their total group size exceeds the maximum capacity for that childcare space. It was explained that this is their responsibility and this is why there are additional outdoor play areas available that are not assigned to other groups during their assigned gross motor times. Currently, our only aide is in the Ohio classroom, and if they needed to split their group to meet capacity, supervision would not be an issue because the group would already require three teachers. The facility had an expired certificate of compliance posted in a conspicuous location used by parents. Requirement: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office. Correction: The current certificate of compliance was found behind the expired certificate of compliance and was immediately replaced so that it was properly posted in a conspicuous location used by parents. Health information/ACIP recommended immunization record (3270.131(a)/3270.131(e))

The file for Child #2, enrolled for more than 60 days, lacked an initial health report and immunization record. Requirement: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP. Correction: Child #2 was not able to return to the facility until we had the required child health report and immunization record on file. A signed child health report signed 1.7.26 was provided with the child's last well check date being 4.10.25. The child was permitted to return on 1.8.26. Inspection: Renewal. Protective Outlet Covers 5 yrs. or less (3270.65)

In Room 6 there was an electrical outlet with Christmas lights that lacked a protective receptacle cover. The outlet was accessible to children 5 years of age and younger. Requirement: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger. Correction: A safety outlet cover was immediately placed in the string of lights in the Michigan classroom. The regulation was explained to the teacher. Inspection: Renewal. Handwashing signs (3270.82(h))

One of the toilets in the Maryland/Delaware Bathroom lacked a posted hand washing sign. Requirement: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. Correction: A new hand washing sign was placed in the Maryland/Delaware bathroom above the toilet where the sign was missing. Inspection: Renewal. Designated release persons (3270.123(a)(5))

The Agreement for Child #2 lacked the persons designated by a parent to whom the child may be released. Requirement: An agreement shall specify the persons designated by a parent to whom the child may be released. Correction: It has been noted on the agreement for child #2 to refer to the emergency contact form for information regarding persons designated by a parent to whom the child may be released. Toddler/preschool: updated health report every 12 months/Initial and subsequent health reports (3270.131(b)(2)/3270.182(1))

The file for Child #3, a Preschooler, contained Health Reports that had been updated in an interval greater than 12 months. Requirement: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child. A child's record shall contain initial and subsequent health reports. Correction: The health report on file is current, but was submitted in February 2024 and the previous was January 2023. Immunization record/Exemption documentation from parent/guardian (3270.131(d)(5)/3270.131(e)(1))

The file for Child #1, enrolled for more that 60 days at the facility, did not contain documentation of a 3rd or 4th dose of the Pneumococcal as required based on the child's age as per the ACIP recommended schedule. Requirement: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in childcare group settings). Child #1 must be dismissed from care by close of business 1/2/25 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter. Correction: The family of child #1 was informed of the issue with the child's missing immunizations. They were advised to reach out to the doctor to find out why the child was missing immunizations. The family was told that if the child is not receiving them, we need a written exemption on file prior to the child returning. The medical provider sent an updated immunization record. There was a discrepancy on the record and the immunizations had been received. The error was corrected and an updated immunization record is on file. Inspection: Renewal. Original label (3270.133(5))

In the Delaware Classroom, Child #2 had expired Children's Ibuprofen and Child #4 had expired Children's Tylenol. Requirement: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label. Correction: The medication belonging to child #2 and child #4 were disposed of due to being past their expiration date. Families were notified. The families were also reminded that all medications brought into the center require a doctor's note, a medication log with signature authorizing us to medicate the child, and the medication must be in the original container so that it can be stored in accordance with the manufacturer's or medical providers instructions. One of the transportation first aid kits for the three vehicles lacked a bottle of water.
