    Restraints prohibited (3270.113(e))

During the complaint investigation the provider, mom, and teacher reported that a chair with safety that is used during breakfast was used to a special visitor event to help child stay seated in his seat to participate in the lesson. Child is autistic, non-verbal and likes to elope. Requirement: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Correction: The provider, teacher, and parent discussed had a meeting with the care team and decided that the chair that has been used as a self-regulation tool has been removed and no longer will be used until the child's IEP is updated. The chair is listed to be used right now just for breakfast. Inspection: Complaints- Legal Location. Source: PA DHS COMPASS provider search (compass.dhs.pa.gov).
