The depth of the rubber mulch near the embedded climber and the embedded swing sets did not meet the recommendations of the United States Consumer Product Safety Commission (at least 6 inches of loose fill rubber mulch). The ground was visible in some areas, and the mulch measured at approximately 2 to 4 inches in other areas. Requirement: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair. TIERED LIS: 1. This portion shall have an immediate correction date. 2. The legal entity must submit documentation in a format approved by DHS proving that the facility has a procedure for ensuring the mulch is being maintained at an appropriate depth on a daily basis. The legal entity will confirm continued compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format. The correction date for this portion of the plan shall be at minimum 3 months from the date the regional office approves the plan. Correction: The mulch depth was made to all the fall zone areas in the swing sets and the climber area on 3/25/25. Daily checks of these areas will occur by a staff person before the children are allowed outside and recorded on a Word document for the next 3 months in order to maintain the 6in depth of mulch. After the 3 months are up of documenting the mulch checks, a staff member will continue to check the mulch daily before the children go outside on the playground. If any area needs fixed, it will be fixed immediately or the children will not be allowed to play in that area until it can be fixed. Comply with CPSL (3270.32(a))

According to documentation on file at the time of inspection, when staff person #1 began working with children at the facility the staff record did not contain the applicable out-of-state certificate as required under the CPSL, and did not contain a copy of the request for the outstanding out-of-state clearances as required for provisional hiring under the CPSL. (CORRECTED ON SITE) Staff person #3 has not completed a DHS mandated reporter training within 90 days of their date of hire (see LIS code sheet). A training for PDE purposes was on file. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to Child Protective Services). Staff person #3 will have until 10/24/24 to complete the mandated reporter training. Until such time as the required training has been completed, staff person #3 must be supervised, when interacting with children, by an AGS or GS who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #3, staff person #3 may not work in a child-care position at the facility. Correction: Staff member will complete the DHS Approved Mandated Reporter training during the Professional Development Day on 10/14/24. From now on, if a person is in hiring process and has a Mandated Reporter training by someone other than the University of Pittsburgh's, we will have the staff take the one from the University of Pittsburgh to make sure that we are meeting the approved training. Staff evaluations (3270.34(a)(6))

Staff persons 4 and 5 received written staff evaluations in May of 2023, and subsequently more than 12 months later in June of 2024. Requirement: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months. Correction: Director will complete staff annual evaluations and have the meeting/staff signature completed within the last 12 months. Inspection: Renewal. A staff person walked out of the child care space to go get the director, leaving a single staff person alone with 11 preschoolers. Requirement: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. Correction: Director met with the staff person to discuss the importance of maintaining teacher/child ratios at all times. Discussion of what the staff person could have done to maintain ratio was also part of that discussion. Health and Safety Training - Pediatric First Aid and CPR (3270.31(f)(10))

Staff person 2 did not complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire. The training was completed 178 days after start date. Another training was on file, but it had expired prior to the person's start date. Requirement: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire. Correction: New staff will have a Pediatric First Aid/CPR training within 90 days of hire or rehire. It is not easy to find a training available when only one or two staff would need it since the group we use has a minimum number of participants that need to be in attendance to host a class. If after contacting the group we use to see if they have a class in the local area, looking through PD Registry for upcoming trainings, contacting other centers in the area, and other ways that we already look for trainings doesn't work, then the staff member's date of hire will need to be adjusted.
