The facility's emergency plan lacked a plan that provides for accommodations for evacuation of children to a location away from the facility premises. Requirement: The facility shall have an emergency plan that provides for accommodations for evacuation of children from the facility building and evacuation of children to a location away from the facility premises. The evacuation routes and evacuation plans to exit the building may be the same as those required by §3270.94 (relating to fire drills). The file for staff person #1 had a health assessment that lacked an examination for communicable diseases and the results of that examination. The file for staff person #3 had a health assessment with the results of a chest x-ray and lacked documentation of a positive tuberculin skin test. Requirement: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department. A record of a person with a positive tuberculin skin test shall include the results of a chest x-ray and evaluation for chemoprophylaxis. The file for staff person #2 had health assessments that exceeded 24 months between assessments. Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. Exemption documentation from parent/guardian/Dismissal policy (3270.131(e)(1)/3270.131(e)(3))

The file for child #1, enrolled more than 60 days at the facility, lacked documentation of the 4th DTAP and 2nd Hepatitis A vaccinations being administered in accordance with the schedule recommended by the ACIP and lacked exemption documentation. Requirement: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child #1 must be dismissed from care by close of business on 6-2-26 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter. Correction: The parent of child #1 submitted a letter stating that she chose to not have her child receive the immunizations due to the child having a reaction from the immunizations in the past. Disposable diapers (3270.135(a)(3))

In the boys' bathroom, there was a small diapering can that contained a pull-up/diaper that had a foot pedal that when pressed was not opening the lid resulting in the diapering can not functioning as a hands-free can. Requirement: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can. Correction: The broken garbage can will be disposed of and a new one will be purchased to replace the broken one. Inspection: Allocated Unannounced Monitoring. Locked or inaccessible (3270.66(a))

In the older toddler room, the cabinet under the changing table was unlocked and contained multiple diaper creams including Desitin that were labeled "Keep out of reach of children" and were accessible to children. Requirement: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Correction: The teachers will ensure that the cabinet under the changing table is closed and locked at all times, so children do not have access to the cabinet. In the 3-4 year old room, there was one area of peeling paint on the wall near the changing table. Requirement: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility. The file for staff person #1 had a child abuse clearance dated 5-13-19 and lacked a current clearance updated within the last 60 months. The file for staff person #1 lacked the out of state Sex Offender and Child Abuse & Neglect registry checks and requires current out of state Sex Offender and Child Abuse & Neglect registry checks. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #1 may not work in a child care position at the facility. Correction: The staff person #1 shall obtain her updated Pennsylvania Child Abuse History Certification Clearance as well as her out of state (Ohio) Sex Offender and Child Abuse & Neglect registry checks and until the clearance is received by the director, the staff member will not return to work. In the girls' bathroom in the hallway across from the infant room, the middle sink lacked a handwashing sign. Requirement: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. In the 3-4 year old room, there were soiled diapers/pull-ups observed that were first placed in a plastic bag inside the plastic-lined hands-free covered can and were not immediately thrown away in the hands-free covered can. Staff stated that soiled diapers/pull-ups are placed in a plastic bag first, and then thrown away in the hands-free diapering can. Requirement: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can. Correction: Director will discuss with all staff that soiled diapers and pull-ups are to be directly discarded in a plastic-lined hands free covered can and not placed in a plastic bag or anything else. The file for child #1 had an initial health assessment that was dated over 60 days after the child's first day of attendance at the facility. Requirement: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.
