7.09(17)(d), 7.11(18)(d) — Administration
While reviewing the Staff Records Checklist and the Staff Educator Schedule there was no evidence that all educators have First Aid. Corrective action: I corrected this by uploading all CPR/FA dates of expiration to the EEC Staff Records Checklist and to the Staff Educator Schedule. After a review of all Educator files; I required several educators to renew their CPR and First Aid. Moving forward, I have added the staff records checklist and staff schedule to the Academy Dashboard with a flag to have them both reviewed every two weeks for changes and or additions. Additionally, I have scheduled a CPR and First Aid mandatory session for 9/2026. This makes the process easier to record and follow when all staff work together to accomplish this training. It will only be new employees that will have different training dates.. Regulation: First Aid Training. All educators must obtain within six months of employment, and must maintain thereafter current certification of training in basic first aid appropriate to the population served., First Aid Training. 14.02 — BRC Information
One educator listed on the Staff Schedule did not have a current BRC, theirs expired in January 2026. Corrective action: I required this educator to immediately cease work until the BRC was completed and suitable. [redacted] current letter of suitability was sent on the Wednesday following the report to the licensor. A copy is on file at the Academy. Moving forward, I will verify each month that all educators are “suitable” and if expiring have them complete the paperwork to upload and go for their fingerprints well in advance of the expiration date.. Regulation: EEC’s BRC regulations are designed to ensure the completion of BRCs on individuals subject to EEC’s oversight, including those in receipt of federal Child Care Development Fund (CCDF) funding pursuant to the Child Care Development Block Grant (CCDBG) Act of 2014 at 42 USC § 9858 and funding through the Families First Prevention Services Act of 2017 at 42 USC § 471(a)(20)(D). Further, BRCs shall be performed in accordance with the statutory framework of M.G.L. c. 15D, §§ 7 and 8, 606 CMR 14.00 and consistent with the timelines established by EEC regulations or policy. EEC is responsible for reviewing all disqualifying information for candidates, with the exception of candidates for adoptive and foster parents to the extent authorized by the Federal Bureau of Investigations (FBI) and state statute. EEC may delegate to another Commonwealth entity its authority to complete BRCs through a Memorandum of Understanding or other applicable agreement to the extent permitted by state and federal law. While effective immediately, EEC will implement the provisions of 606 CMR 14.00 in phases and provide updated timetables for implementation within its written policies. Nothing in 606 CMR 14.00 shall be construed to create a private right of action if an EEC licensed, approved or funded program has acted in accordance with 606 CMR 14.00 and any policies adopted thereunder. 7.04(14)(c) — Postings
The Allergy/Special Conditions list posted in the toddler/preschool classroom was outdated. The children listed were no longer in that classroom and a child in that classroom with [redacted] and medication was not listed. Corrective action: I contacted the family and requested they bring in all current medical information for the file. File was completed with current information and put in red folder on door and in the red emergency 'to go' bag. Moving forward, my new procedure is to review all emergency folders and paperwork monthly (or sooner if needed) in order to update room door red folders, and to update staff as soon as necessary. When a child moves from a room to move to the next level room all paperwork will be refreshed and training will occur with the staff of that new room. This new procedure will include a written checklist for each individual that has allergies or special conditions that will be signed off on and put in the child’s file. A red multi layered file is complete with medication consents, insurance info, doctor notes and orders, prescriptions and emergency numbers for parents clearly notated as well as pertinent facts on the child. A red emergency backpack with the child’s name on the outside will follow with the child and will be updated monthly unless changes happen and will be immediately updated with new information and medications.. While reviewing the Staff Records Checklist and the Staff Educator Schedule there was no evidence that at lease one staff person certified in CPR was present at any given time while children were in care. Corrective action: I uploaded all CPR/FA dates of expiration to the EEC Staff Records Checklist and to the Staff Educator Schedule. I have also made sure that all but two of our Educators are compliant. The two not compliant are working on completing the training necessary to become compliant by the 4/30/2026. Both files; staff schedule and staff educator checklist will be uploaded to the portal by 5/22/26. Beginning now, I will weekly check the staff schedule to verify that all certifications and dates are listed for each staff member. I will monthly keep a record of who needs what done and a deadline for completion and certificate in the individuals personal file.. Regulation: The licensee must ensure that at least one educator currently certified in first aid and age-appropriate cardiopulmonary resuscitation (CPR) is present at any and all times when children are in care., CPR training must be renewed annually. The Fire Dept # 2 has been contacted as to the CO2 devices. They reported that we do not need them as we have one in the boiler room for the commercial system here. In speaking with our building and grounds chairman about this; we decided to add them to the room in order to be compliant with the EEC regulation. These are ordered and arriving here tomorrow to be put in place tomorrow or Saturday depending on arrival.. Regulation: Carbon Monoxide Detectors. Additional TA advice that has been seen to and corrected or added to our Academy rooms. -The plug covers are in place around the room. -More books have been added to the quiet area. -Lock in place on door that stores chemicals. -White cable covers are arriving tomorrow and will be in place upon arrival Friday or over the weekend. -Couch covers will be in place by tomorrow. -Preschool-Toddler Room: Cubby units will be in place for art/science/math centers by Friday with some items and others materials as they arrive next week.. Regulation: The licensee must ensure that the physical facilities are safe, clean, in good repair and free from hazards and clutter. The licensee must monitor the environment daily to identify and remove or repair any hazards that may cause injury to children. Exits and evacuation routes must be kept clear of obstructions., The educator must hold practice evacuation drills with all groups of children and all educators from each floor level of the approved space at least monthly. Drills must be held during different times of the program day, and must use alternative exits.
