(b) (3) Each aboveground pool shall have non-climbable sidewalls that are at least four feet high, or shall be enclosed by a fence at least five feet high to prevent chance access by children. The fence and the gate shall meet the requirements in paragraphs (b)(1) and (b)(2). Steps and ladders shall be removed and stored away from the pool when the pool is not in use. Each aboveground pool with a deck or berm that provides a ground-level entry on any side shall be treated as an inground pool.

There is an above ground pool on the premises that is close to the fenced-in playground area. The pool height is not at least 5ft high, nor is there a fence around the pool. The fence to the playground area was recently heightened to at least 5ft high; however, there is one area where there is a gap between the ground and the fence that is greater than 3.5 inches. Soap used for hand washing may be kept unlocked and placed on the back of the counter by a sink.

There are variety of cleaning supplies and bodily care products in the basement (main care area) and in the restroom that are accessible to children under six years of age.
