Sec. 7-33(e), Ordinance: Direct supervision means watching and directing the childrens activities within close proximity within the same room inside or within a designated outdoor play area and responding to each childs needs. Inadequate supervision occurred when a child/childrens needs were not met in the following incident: [4y/o child observed sleeping on top of stacked cots]. Ratios/Discipline [SR] Comments: During the course of a complaint inspection related to discipline the following non-compliance was observed; A child was observed sleeping, or attempting to sleep on top of a stack of cots. I proceeded to ask the teacher why the child was sleeping on top of a stack of cots to which she responded that it was because the child "didn't bring sheets. The other children had sheets and blankets and she didn't". I proceeded to inform her that it is not an excuse for allowing a child to sleep on top of a stack of cots. The teacher proceeded to tell the child that she could sit at the table if she didn't want to lay there, but the child remained on top of the stack of cots. The child's needs were not met in this instance, as the teacher did not provide her with the cot or bedding. This is the third occurrence of this non-compliance in a 2-year period. Previous non-compliances were issued on 3/18/2025 and 4/2/2025. A Notice of Violation was issued on 4/2/2025. Therefore, a second Notice of Violation is being issued on this inspection. 08. Sec. 7-44(f), Ordinance: The childs arrival and departure must be recorded by child care personnel at the time the child enters and departs the child care facility. The attendance sheet/class roster must accompany the child care personnel and the group of children throughout the day should they leave the classroom. In order to account for childrens whereabouts, children who are reassigned to different classrooms throughout the day should be signed in and/or out of the rosters for those respective classrooms each time. The facility failed to maintain an attendance roster for the children in care. Registration/Certificates [SR] Comments: At the time of inspection, the licensing monitor observed the facility failed to document on attendance rosters the reassignment of a child moving to multiple classrooms. Ratios/Discipline [SR] Comments: The licensing monitor observed the VPK classroom without a teacher present. When the monitor brought this concern to the attention of the teacher returning from the restroom, the VPK teacher stated the 4's teacher in the partitioned classroom next to VPK was watching the children for her. The 4's classroom teacher was not in line of sight of the VPK classroom. The monitor informed the teacher, director, and program owner of the inadequate supervision requirement. The following ratios were observed: 2's 1:5, 1:9 3's 1:11, 1:14 4's 1:13 VPK 1:16 (Ratio brought into compliance when the teacher returned to the group) Following progressive enforcement procedures, a Notice of Violation is being issued for Inadequate Supervision as this standard was previously cited out of compliance on 3/18/25. 3.12(C), Handbook: All equipment, fences, and objects on the facilitys premises shall be free from sharp, broken and jagged edges, and properly placed to prevent overcrowding or safety hazards in any one area. 3.1(A), Handbook: All child care facilities must be clean, in good repair, free from health and safety hazards and from evidence of, or presence of, vermin infestation. Areas of the facility were found to be in need of repair. Facility/Storage [SR] Comments: Assistance was given to the provider for the following areas of concern: -Light cover in 3's classroom needs to be replaced. -Repair broken outlet plug in 2's classroom. -Dust AC vents throughout the facility. -Remove clutter from changing tables. Ratios/Discipline [SR] Comments: The following ratios were observed: 2's 1:9, 1:8 3's 1:13, 1:12 4's 1:8 VPK 1:11. 2:11 While walking to the 4's classroom, two students went ahead of the teachers in line to enter the classroom. Per the director, Child A stated she was running in the classroom with Child B. Child B lost her balance and bumped into Child A causing her to knock her head on the bookshelf. At the time of incident, the teachers were in the hallway tending to the other children in line. Child A ran out of the classroom to inform the teacher of the incident. 10. Child Discipline/Child Abuse & Neglect: DCF Handbook, (10-01)

7-21.05(a), Ordinance: Child care facilities and programs must ensure that age appropriate, individual constructive disciplinary practices are used for each child in care. (1) Children shall not be subjected to discipline that is severe, humiliating, or frightening. (2) No cruel, harsh, physical, or unusual punishments shall be permitted. (3) No child shall be delegated or permitted to discipline another child. (4) No physical restraints shall be used to confine a child. (5) No child shall be confined in an enclosed area such as a closet, locked room, box, or bathroom. (6) No child shall be subjected to profane language, threats, derogatory remarks, or other verbal abuse. (7) No child shall be punished for failure to eat or sleep, or for toileting accidents. (8) No child shall be punished by the withholding of food, rest, or use of the toilet. (9) No physical punishment shall be used, such as, but not limited to, hitting, striking, biting, or pinching. (10) No child shall be threatened with any punishment that is prohibited by this paragraph. (11) Spanking or any other form of physical punishment is prohibited unless such discipline is a part of the religious tenets, doctrine, or practice of the facility. An inappropriate method of discipline was used. Ratios/Discipline [SR] Comments: During today's revisit inspection unrelated to discipline, I observed a teacher on the playground, sitting on a bench, bent over and yelling at a child's face while she held his hands, then she proceeded to slap him on the hand. I rushed to her and on my way to her I said "hey, hey, hey! you don't do that" but she did not turn to me. When i arrived at the fence I said "you don't do that" and we started to have a discussion at that point. The teacher was telling me that the child slapped her so she hit him. I reminded her that she is not his mother and that she has no right to hit the child. She proceeded to tell me that he has been hitting her since yesterday and that she isn't going to let him keep hitting her. I reminded her that she is an adult, the child is two years old and she cannot put her hands on the children. A notice of violation is being issued. The section number cited above in incorrect.
