Sec. 7-32, Ordinance: Before the first day of employment at a child care facility, all child care personnel, excluding temporary substitutes, must have on file at the child care facility a signed statement from a licensed physician or authorized agent of the Florida Department of Health attesting that the person is in good health in order to care for children in a child care facility setting. The health assessment statement shall be documented on a form prescribed by the local licensing agency and updated at least every two years. Child Care personnel did not have a current health statement on file. Comments: At the time of this inspection it was noted that one staff person did not have on file a signed statement of good health. 06. 3.8.4(A) and (C), Handbook: During the facilitys license year, fire drills utilizing the alarm system, approved by the local fire authority, must be conducted monthly at various dates and times when children are in care. The operator must maintain a written record of the fire drills showing the date, number of children and child care personnel in attendance, evacuation route used, and time taken for all individuals to evacuate the premises. Each fire drill record must be maintained for a minimum of 12 months from the date of the fire drill. There was no documentation available to show that monthly fire drills have been completed for the month(s) of [see below]. License/Certificates [SR] Comments: At the time of this inspection it was noted that the facility had not conducted fire drills for the months of November and December. 2.8(A-B), and (F)(1-9), Handbook: The child care facility shall adopt a discipline policy consistent with Section 402.305(12), F.S., including standards that prohibit children from being subjected to discipline which is severe, humiliating, frightening, or associated with food, rest, or toileting. Spanking or any other form of physical punishment is prohibited. The child care facility operators, employees, and volunteers must comply with written disciplinary and expulsion policies. The following discipline techniques shall be prohibited in the child care facility: the use of corporal punishment/including, but not limited to: hitting, spanking, shaking, slapping, twisting, pulling, squeezing, or biting; demanding excessive physical exercise, excessive rest, or strenuous or bizarre postures; compelling a child to eat or have in his/her mouth soap, food, spices, or foreign substances; exposing a child to extremes temperature; rough or harsh handling of children, including but not limited to: lifting or jerking by one or both arms; pushing; forcing or restricting movement; lifting or moving by grasping clothing; covering a childs head; isolating a child in an adjacent room, hallway, closet, darkened area, play area, or any other area where the child cannot be seen or supervised; binding, tying or restrict movement, or taping the mouth; using or withholding food or beverages as a punishment; toilet learning/training methods that punish, demean, or humiliate a child; any form of emotional abuse, including rejecting, terrorizing, extended ignoring, isolating, or corrupting a child; any abuse or maltreatment of a child; abusive, profane, or sarcastic language or verbal abuse, threats, or derogatory remarks in front of the child or about the child or childs family; placing a child in a crib/portable crib for a time-out or for disciplinary reasons. A method of discipline was used that was inappropriate in that [see below]. Ratios/Discipline [SR] Comments: Complaint allegation was received alleging that on Wednesday December 11, 2024 the child (K) was put into time out in the bathroom. The parent stated that the next day she spoke with the director M.D. and was told the teacher that put her child in the bathroom for time out was fired. A complaint investigation was conducted on December 19, 2024 and the director M.D. e was interviewed. M.D. stated that the child was placed in the restroom for time out by the teacher with bathroom door open however the child kept closing the bathroom door and the teacher kept opening the door but eventually the child was left in the bathroom with the door closed. This complaint is found to be substantiated for inappropriate discipline. The discipline used was against the providers discipline policy and the teacher was terminated for not following the discipline policy. FACILITY/STORAGE 10.
