4.7(A), Handbook: Each child care facility must have a credentialed director who is on-site a majority of hours, excluding weekends and evening hours that the facility is in operation. Documentation of majority of hours must be maintained and available for review by the licensing authority. The credentialed director is not on site on a regular basis enough to meet this standard. Sec. 402.305(4)(a), Florida Statutes: Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. A ratio of [2] child care personnel for [8] children is required. A ratio of [1] child care personnel for [8] children was observed. Ratios/Discipline [SR] Comments: During the onsite complaint visit, the Toddlers classroom was observed during naptime with (1) childcare personnel and (8) children. 17. Equipment and Furnishings Group: Sec. 7-36, Ordinance and DCF Handbook (17-01)

Sec. 7-36(a)(1), Ordinance: Toys, equipment, and furnishings must be in a usable, safe, and sanitary condition and shall not present a choking hazard for children. 3.11(A), Handbook: A child care facility must make available toys, equipment, and furnishings suitable to each childs age and development. Toys, equipment and/or furnishings available to the children in care were not age appropriate in that [toddler chairs were too tall for the children in care in the 1y/o room.]. Indoor/Outdoor Space [SR] Comments: Complaint alleges that a child had a busted lip on t wo separate occasions for unknown reasons and an incident report was not provided. A complaint investigation was conducted on 5/21/2026 and completed on 5/22/2026. After reviewing staff statements and conducting an inspection of the classroom, the child fell asleep while sitting on a chair that was not age appropriate. The child fell off the chair after falling asleep, which resulted in a busted lip. With regards to the first incident, the teacher and assistant director denied having any knowledge of it or any other incident involving a busted lip. Per teachers statement (Ms. X. R), during lunch time, the child (J. E.) was dozing off while sitting on the chair at the table. The teacher explained that she wet the childs face several times to keep the child awake. The child fell asleep on the table, and the child fell on the ground and hit his mount, hurting his top lip on the floor. Technical assistance provided: 1. Provider was advised that children should be provided the opportunity to rest if they are sleepy or tired, and not be made to stay awake, as accidents like this can occur. 2. The chairs in the classroom are not age appropriate; facility was granted a deadline to replace the chairs and adjust the table to the childrens level. This complaint is substantiated. 18. 23. Outdoor Play Space Group: Sec. 7-5.03, Ordinance and DCF Handbook (23-12)

3.5.1(D), Handbook: The outdoor play area must have adequate fencing or walls a minimum of 4 feet in height. Fencing, including gates, must be continuous and must not have gaps or opening larger than 3 inches that would allow children to exit the outdoor play area. The base of the fence must remain at ground level, and be free from erosion or build-up to prevent inside and outside access by children or animals. These areas must have at least two exits, with at least one being remote from the buildings. If an outdoor play area was approved for usage by the Department prior to the effective date of this rule, no new exits are required to be added to meet this standard. However, if outdoor play area fencing is changed then the standard would apply and two exits must be provided. The facilitys fencing was inadequate in that [chain link fence needs upper clips]. Sec. 7-5.03(i), Ordinance: All equipment must be installed safely and maintained in a safe condition. All play equipment shall be of substantial construction and free from rough edges, sharp corners, pinch and crush points, splinters, and exposed bolts. Ladders on slides must have a handrail.
