The provider received technical assistance and the operator was informed that during an inspection, the Licensing Specialist (LS) needs access to the childcare facility. The owner, operator, employee or substitute failed to grant the licensing authority access to facility records. s. 402.311, F.S. Comments: Non- Compliance Description During the inspection, LS did not have access to the facility records. According to the employee, They did not know where the records were. Then called the director and was told that there were no keys at the facility to access the records so LS had to go another day to access the record. Technical Assistance was provided to the provider by informing the employees and director that LS needs to have access to the files during business hours to complete an inspection. Counselor Comments A copy of inspection was sent via email to provider Training: All in-service trainings must be completed for the fiscal year beginning July 1 and ending June 30. The employer/owner/operator must add child care personnel to their Employee/Contractor Roster in the Clearinghouse within 10 days of when the individual has received a child care eligible result and has been hired at the facility. Employer/owner/operator must add an end date for individuals on the Employee/Contractor Roster in the Clearinghouse within 10 days of the employment termination. Background Screening Update - During 2016, all providers were required to re-screen childcare personnel that had background screening dates completed prior to July 1, 2016, to address new screening components for existing staff. Screenings processed in the Clearinghouse during 2016 will need to be RENEWED in 2021 for an additional five (5) years. The Clearinghouse system is set up to send automated notifications to providers at 60 and 30 days prior to the Retained Prints Expiration Date, only for employees that have been added to the facility roster. Providers need to keep their roster current and notify licensing when their email address has changed. Failure to RENEW retention of prints will change the individuals status from Eligible to A New Screening is Required - which means that the individual needs to restart to have their fingerprints Live Scanned into the Clearinghouse system. A Resubmission is NOT the same as a RENEWAL. A Resubmission is used when an individual has had a lapse in employment greater than 90 days and triggers a rescreening of required components and a new screening status is issued. Please do not use Resubmission. The RENEWAL: 1. required every five (5) years beginning from when the fingerprints entered the Clearinghouse; this is not based on the eligibility date. 2. used to continue retaining the fingerprints in the system for an additional five (5) years. 3. triggers a rescreening of required components and a new screening status is issued. 4. cost $43.25 and can be paid using a credit card or electronic check within the Clearinghouse. If your background check and fingerprints are up for renewal, please ensure to obtain Level 2 screening as outlined in s. 435.04, F.S., is required for all childcare personnel and includes a criminal records check (both national and statewide), a sexual predator and sexual offender registry search, and child abuse and neglect history of any state in which an individual resided during the preceding 5 years. All fingerprints must be submitted and processed through the Background Screening Clearinghouse and therefore a Live Scan vendor that is Clearinghouse compatible must be used for submission of fingerprints. Background screenings may be obtained in advance of their expiration date to ensure there is no lapse in coverage. SB 252 is effective on October 1, 2021. Effective May 2019, permanent or stationary playground equipment must have a fall/use zone that extends a minimum of six feet in all directions from the perimeter of the equipment. All types of ground cover must be maintained to provide resilience and reduce the incidence of injuries to children in the event of falls. Its important to note if the permanent or stationary playground equipment is moved or replaced, and the program has been grandfathered into the standard and received a waiver/variance, then the standard would apply and six feet of use zone must be provided. Any new equipment added would be required to have the six feet of use zone in all directions from the perimeter of the equipment. Effective December 31, 2021, the facility shall maintain the following number of child care personnel with the CPR certification and first aid training that are on site at the facility at all times children are in care. For child care personnel to count to meet requirement in the below chart, they shall be child care personnel assigned to provide direct supervision of children in care: For 0-25 personnel, at least 3 certified For 26-50 personnel, at least 4 certified For 51-75 personnel, at least 5 certified For 76-100 personnel, at least 6 certified For 101+ personnel, at least 7 certified A Director, on site when children are present, with pediatric CPR certification and first aid training may qualify as one of the child care personnel for purposes of meeting the above requirements. Documentation of pediatric cardiopulmonary resuscitation (CPR) certification and first aid training must be kept on file and available for licensing to review.
