746.4601(3) - Safety Requirements for Active Play Equipment - No Entrapment Openings

During the inspection a child's head became entrapped in an opening in the ship structure on the large playground. A photo was taken. Note: This was corrected during the inspection when the opening was covered with boards. A photo was taken.

746.3407 - Maintenance of Building, Grounds and Equipment

During the inspection a toilet in the front schoolers building was observed to be clogged and having issues flushing. This was corrected during the inspection. In the back nursery room there was an open closet that needs addressed. In the shooting stars classroom a toilet is out of order and repair works needs completed on the wall behind it. In the robins classroom the restroom has a broken cabinet that needs fixed.

746.2805 - Prohibited Punishments - No Harsh, Cruel or Unusual

Based on information gathered in a DFPS investigation, evidence supported that a caregiver used prohibited discipline and guidance which included a child in a chokehold and grabbing/pulling another child by the ear.

746.1201(4) - AP Responsibilities of Employees and Caregivers -Ensure No Child Abused, Neglected, or Exploited

This standard was found deficient as part of a DFPS Investigation regarding a caregiver using prohibited discipline and guidance on children in care.

746.1205(a)(4) - Supervision ensures each child?s safety, well-being, including physical proximity and auditory or visual awareness of each child?s on going activity

Based on information obtained in a DFPS investigation a caregiver left the children in their group unattended for approximately a minute when they left the classroom to get something.

745.641 - AP Background check results - Must receive notification prior to allowing subject to be present at your operation

A caregiver without an active eligible background check was present in a 3-5 year old classroom. Note: The operation sent the caregiver home and submitted a background check for the caregiver.

746.501(a)(14) - Written Operational Policies - Transportation

The operation has a strong written transportation emergency preparedness plan which includes procedures for restroom emergencies while in transport. However, the policies were not followed as there were no planned restroom stops for a field trip that was about an hour and a half drive away. The policies also were not followed when a child urgently had to go to the bathroom. While information gathered in the investigation indicated staff could not pull over at the time due to stand still traffic, they also did not follow their policies by pulling over when they safely could as the child ended up going on the bus as they were unable to hold it. While the parents were notified of the incident and all parents notified of arrival at the center being delayed from the field trip due to traffic, the director was not notified immediately of the restroom emergency by staff which is in their policies.

746.307(c) - Parental Notification of Less Serious Injuries

Information from the DFPS investigation indicated a parent was not notified until the next day about an injury in care that occurred.
