Supervision Of Children (251.055(1)(a))

According to staff statements and video footage, 3 children were not within sight and sound supervision to prevent harm and ensure safety for approximately 10 minutes on 2/13/2026. According to staff statements, 3 children in the Yellow Room had left their assigned group, and travelled down the hallway to the bathroom, where they were found playing in the toilet. One of those 3 children escaped a second time and was found by himself in the center kitchen. Child Tracking Procedure (251.055(1)(f))

The center's child tracking procedure was not followed when 3 children in care in the Yellow Room left their assigned group and travelled down the hallway to the bathroom. The children were noticed playing in the toilet in the hall bathroom by a staff member from a classroom across the hallway, and an additional staff member in the center collected and returned the children to the Yellow Room. After the 3 children were returned to their classroom, one of the 3 children escaped again and was found in the center kitchen, according to staff statements. Upon a review of attendance records on 2/13/2026, it was discovered that there were 10 children under age one in care in the Green Room for approx. 55 minutes. According to staff statements, 3 children in care in the Yellow Room eloped from the assigned classroom staff and travelled down the hallway and into a bathroom. A staff member found the children playing in the toilet water, potentially ingesting it. It was observed during the complaint visit that the toilets contained toilet bowl cleaning product, resulting in children potentially ingesting poisonous chemicals at the time of the incident. Upon review of attendance records from 11/10/2025, the center did not have accurate documentation of days & hours worked and in which specific classrooms for staff who are being counted in staff-to-child ratio. Attendance records indicated that staff were not signed into the room in which they were counted in staff-to-child ratio for a period of approx. 30 minutes when multiple groups of children were outside, & again between 4:06pm and 5:30pm when staff were not signed into the room in which they were providing care and supervision to children.
