Regulation 6.2.6.1: Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.

Factual basis: A 17 month old child was left alone in the classroom for at least 5 minutes without staff knowledge. The staff and children went to the gym and once there, realized the child was not with them. This is a repeat violation previously cited on 12/3/2020. This is a serious violation. Corrective action: By 4/22/2026, submit a program improvement plan that will identify how the programs systems and supervision protocols will be reviewed and updated. The plan will describe how staff supervision practices will change to ensure that children are not being left behind and detail how internal training to educate existing staff will occur as well as onboarding new staff on the newly developed plan for supervision during transition times. A Parental Notification Letter, which is a copy of the licensing report, must be provided to each parent of every child enrolled within ten (10) days of the report submission. Regulation 7.1.3: The licensee, in consultation with the program director, shall establish written program policies and procedures and provide these to staff and to auxiliary staff left alone with children and/or counted in staff/child ratio as specified

Factual basis: It was identified that five (5) staff have not completed the required Orientation training. Corrective action: Have the identified staff complete the required Orientation training as soon as possible. Submit confirmation of plan for staff to complete the Orientation. Regulation 5.2.1.8: Staff shall wash the hands of children who are unable to wash their own hands and provide developmentally appropriate guidance and supervision to help children learn and practice healthy hand washing.

Factual basis: It was observed that Staff A did not wash an infants hands after having their diaper changed in the older infant classroom. It was also observed in the younger infant classroom that Staff B did not wash the hands of two infants after having their diapers changed and then sat in high chairs to eat lunch. Corrective action: Immediately instruct staff to always wash hands of infants after their diapers are changed and before they eat. Submit an email on how staff have been instructed to wash hands of infants when required and how staff will be supervised to ensure handwashing is occuring when necessary. Regulation 5.4.1.5: Children shall be supervised by staff while napping or resting. Staff shall directly observe a sleeping infant at least every fifteen (15) minutes to check the infant's face, view the color of the infant's skin, and check on the infant

Factual basis: It was observed that an infant was sleeping in a nap room from 11:10 am-11:33 am without a 15 minute in person check occurring as required. Corrective action: Effective immediately, infants are to be directly observed every 15 minutes while they are sleeping. Ensure all staff who are assigned to work in the infant room, are trained in safe sleep practices including 15 minute in person checks while infants are sleeping. Factual basis: An infant was observed to be sleeping in a swing for ten (10) minutes. No staff attempted to transfer the infant to a crib as required. When asked, the staff said that the child had slept for 20 minutes in their crib and then was moved to the swing where they slept for 15 minutes before waking again. Corrective action: Effective immediately, all infants under age twelve (12) months may not sleep in swings. Submit confirmation that staff are trained in safe sleep practices and that safe sleep practices are always being maintained. Factual basis: Staff X and Staff Y were in the gym on the second floor with 14 children. Five (5) of the children needed to use the bathroom. Staff X brought the five (5) children to a bathroom located on the first floor with no other staff present. Staff X does not have approval from the results of the fingerprinting background check and may not be left alone with children. Corrective action: Effective immediately, ensure that only staff with approved background checks that include fingerprinting are left alone with children.
