Program leaders shall be at least 18 years of age, have fulfilled a high school program completion or the equivalent, and meet one of the lead teacher qualifications. Staff #7 is the lead in a classroom per the administrator and does not meet one of the lead teacher qualifications.

Staff records shall be kept on each staff person and contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. Staff #6 has been employed for four weeks and only had one reference on file.

A copy of any special order issued by the department shall be posted in a prominent place at each public entrance of the licensed premises to advise consumers of serious or persistent violations. The special order delivered two months prior was not posted at the facility.

Nonprescription drugs and over-the-counter skin products shall not be kept or used beyond the expiration date of the product. A sunblock that expired nine months age, a diaper ointment that expired two months ago, and a diaper ointment that expired 10 months ago were kept at the center. A diaper ointment that expired 15 months ago and was used on the child in January and is still kept at the center.

REPEAT VIOLATION The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards. The center's discipline policy states .... at no time will staff use punishment of any kind... Children will not be punished..., or be allowed to punish another child.." On February 6, 2026, Staff #1 used physical punishment and allowed a child to punish another child.

REPEAT VIOLATION When staff are supervising children, they shall always ensure their care, protection, and guidance. On February 6, 2025, Staff #1 did not ensure proper guidance when guiding Child #2's hand to smack Child #1 twice across the face, knocking child #1 to the floor. Staff #1 did not ensure the care of Child #1 by failing to check for injury after the child fell to the floor crying. Both children are two years old.

Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. On February 6, 2025. Staff #1 used physical punishment as a form of behavioral guidance in response to a two year old child hitting another two year old child instead of redirecting the child or using constructive, age-appropriate guidance.

The following actions or threats thereof are forbidden: Punishment by another child. On February 6, 2025, Staff #1 used Child #2's hand to smack Child #1 twice across the face as a form of punishment. The second smack knocked Child #1 to the floor crying.

For each group of children, the vendor shall maintain a written hard copy record of daily attendance that documents the arrival and departure of each child in care as it occurs. The Pollywog room had not kept a written hard copy record of daily attendance for the month of November and the Bee's room had not kept a written hard copy record of daily attendance since November 14, 2024.

The center is required to keep a current list of all known allergies, sensitivities, and dietary restrictions in each room or area where children are present. The list must be dated and kept confidential. The allergy list in the Butterfly classroom was not accurate per staff. Two children were listed that no longer should be and one was not listed.

The center did not follow their own written procedures for safe sleeping practices which state the following: No loose bedding, pillows, bumper pads, etc. will be used in cribs. In the Angelfish classroom a loose blanket was in the crib with a five-month-old sleeping baby.
