   The provider was out of compliance with this rule by not ensuring that staff members who were 16 or 17 years old only had unsupervised contact with any child in care when the director or director designee was physically present and available as needed. At the facility, there was a 17 year old caregiver who was left alone unsupervised with a child when there was no director or director designee physically present and available as needed. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On 10/7/2024, the licensor verified that the director designees both came back to the facility so that the 17 year old caregiver was no longer left unsupervised at the facility with the child without a director or director designee present as stated in rule.

   R381-100-19(4)(a)-(c) — Use zones

   The provider was out of compliance with this rule by not ensuring that stationary play equipment had a surrounding use zone that was at least six feet if the play surface was higher than 20 inches and used by school-age children. On the playground, there was a piece of stationary play equipment that had a play surface higher than 30 inches and used by school-age children that did not have at least a six foot use zone around it. This was a repeat rule noncompliance. Inspection: Unannounced, Annual Inspection. Repeat noncompliance. Civil money penalty: $300. Correction status: Correction Verified. Correction action: On 10/7/2024, the licensor verified that the director designee moved the stationary play equipment so that it had at least a six foot use around it as stated in rule.
