The provider was out of compliance with R381-100-12(5)(a) by failing to ensure that interactions with a child do not include any action that produces physical pain or discomfort, including hitting, spanking, shaking, biting, or pinching. During an investigation it was determined that a caregiver spanked a child after the child had escaped their classroom and ran out into the parking lot and toward a side street. This is a repeat citation as noted on 05/04/2023. Inspection: Investigation Inspection. Repeat noncompliance. Civil money penalty: $200. Correction status: Manager approval, no follow up needed. Correction action: On 09/04/2025, the investigator verified that the staff member was provided retraining on guidance and interaction and supervision, as required by rule.
