R381-100-11(1)(a)-(g) — Provide and maintain active supervision

Then provider was out of compliance with R381-100-11(1)(c) by failing to ensure that each caregiver provided and maintained active supervision of each child including knowing the number of children in their care at any time. During an inspection, it was determined that a child was left unattended outside when the caregivers miscounted the number of children they had in their care when they came off of the playground and returned to their classroom. Correction action: On September 29, 2025, the licensor verified that the provider had re-trained staff to ensure every child is provided with active supervision, and that caregivers maintain active supervision, as required in rule.

R381-100-7(9)(a)-(g) — Caregiver requirements

The provider was out of compliance with Rule R381-100-7(9)(b) by not ensuring that caregivers completed the 2-1/2 hour preservice training offered by OL before becoming involved with child care. At the time of the inspection, there were two caregivers involved with child care who did not complete the 2-1/2 hours of preservice training offered by OL. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On 7/8/2025, the licensor verified that the two caregivers completed the preservice training as stated in rule.

R381-100-19(15)(a)-(c) — Shredded wood product cushioning requirements

The provider was out of compliance with this rule by not ensuring that shredded wood products used as protective cushioning met depth the requirement guidelines in Table 3. On the 3 and older playground, the shredded wood products did not meet the depth requirement guidelines in Table 3. This was a repeat rule noncompliance. Inspection: Announced, Annual Inspection. Repeat noncompliance. Civil money penalty: $150. Correction status: Correction Verified. Correction action: On 12/3/2024, the licensor verified that the director had added more mulch to the use zone on the playground so that it met the depth requirement of 9 inches as stated in rule.
