R381-100-12(4) — Gentle, passive restraint

The provider was out of compliance with R381-100-12(4) by conducting multiple unnecessary physical restraints on a child that was not injuring themselves, others, or destroying property. During the investigation inspection, the information gathered from facility video coverage, provider records, and multiple interviews substantiated that on 06/09/2025, two staff members restricted a child’s freedom of movement and normal access to their body for refusing to turn over a cell phone to staff members. R381-100-14(10(a)-(c) — Incident, accident, injury report requirements

The provider was out of compliance with R381-100-14(10) for not giving each parent a written report on the day of occurrence of each incident, accident, or injury involving their child. During the investigation inspection, an incident was identified to have occurred on 06/09/2025. A parent of the child involved disclosed that they were verbally told about the incident on 06/09/2025 and were provided with a written report on 06/10/2025. Correction action: On 08/08/2025, the licensing investigator verified the provider came into compliance by conducting staff training on accident and injury reporting requirements, as required by rule.

R380-80-4(2) — Report abuse or neglect

The provider was out of compliance with this rule for not reporting allegations of child abuse to Child Protective Services or law enforcement. During the investigation inspection, the evidence substantiated that a staff member reported an incident of alleged physical abuse of a client to the provider; the provider did not report the allegation to the required agencies. Correction action: On 11/26/2024, the licensing investigator verified the provider came into compliance training on reporting to CPS when an abuse allegations is made, as required by rule.

R380-80-6(1)(a)-(i) — Client rights

The provider was out of compliance with this rule by a staff member not ensuring clients were free from potential harm or acts of violence. During the investigation inspection, interviews, provider documentation, and facility video coverage substantiated that a staff member smacked two babies on the mouth.
