R430-90-13(4) — Choking hazards

The Licensee was out of compliance with R430-90-13(4) by not ensuring that choking hazards were inaccessible to any child under three years old. In the upstairs playroom, there were choking hazards accessible in the lower cabinet on the TV stand as well as in the top drawer of the diaper storage unit. Inspection: Announced, Annual Inspection. Correction action: On March 25, 2026, the licensor verified the Licensee ensured that choking hazards were made inaccessible to any child younger than three years old, as stated in rule.

R430-90-7(4)(a)-(g) — Caregiver requirements

The Licensee was out of compliance with R430-90-7(4)(a)-(c) by having a caregiver on site that had not completed the Pre Service training requirement. At the time of the inspection, one caregiver had not completed the Pre Service training. Inspection: Unannounced, Annual Inspection. Correction action: On 03/25/2026 the licensor verified that the Licensee ensured caregiver requirements were completed as stated in rule.

R430-90-12(1) — Physical, emotional or sexual abuse

The provider was out of compliance with R430-90-12(1) by a child being subjected to sexual abuse while in their care. During the inspection, the Office coordinated with Child Protective Services (CPS) and they supported a finding of sexual abuse of a child while the child was receiving care in the provider’s home.<br/> Inspection: Complaint, Investigation Inspection. Correction action: On May 26, 2026, June 01, 2026, and June 12, 2026, plan of correction inspections were completed and it appears that Tyson Coleman did not have direct access to any children receiving child care services ensuring health and safety as required by rule.

R380-600-3(4) — Conduct towards department representative

The provider was out of compliance with R380-600-3(4) for permitting a staff to verbally abuse or use violence of any kind while interacting with a representative of the Department. After an attempted follow-up inspection, the provider contacted a Department Manager and used verbally abusive language towards them. R380-600-7(3)(a)-(d) — Provider must grant full access for rule compliance monitoring

The provider was out of compliance with R380-600-7(3) by failing to cooperate with OL to monitor rule compliance and rule compliance maintenance any time the facility is serving clients by giving OL full access to the building. During a follow-up investigation inspection, the provider failed to allow OL access to the site to conduct a follow inspection of previously cited rules. The provider was out of compliance with R430-90-8(2)(c) by failing to ensure a new covered individual who does not appear in the licensing provider portal search becomes involved with child care in the program. During an investigation, it was determined that a new covered individual did not complete a background check before becoming involved in the child care. Inspection: Investigation Inspection. R430-90-24(15) — Infants sleep in equipment designed for sleep

The provider was out of compliance with R430-90-24(15) by failing to ensure that each infant sleeps in equipment designed for sleep including a crib, bassinet, porta-crib or playpen, and that an infant is not placed to sleep on a mat, cot, pillow, bouncer, swing, car seat, or other similar piece of equipment. During an investigation and after reviewing cell phone footage of an incident, it was determined that an infant was allowed to sleep in a stroller when they fell asleep outside when they were with the provider and other children and they began to fall asleep and the provider rolled them into the home. Inspection: Complaint, Investigation Inspection. Civil money penalty: $200. Correction status: Manager approval, no follow up needed.

R430-90-12(5)(a)-(g) — Interactions with children

The provider was out of compliance with R430-90-12(5)(d) for failing to ensure that each interaction with a child does not include confining a child in a closet, locked room, or other enclosure. During an investigation and after reviewing cell phone video of an incident, it was determined that an infant was confined to a walk in closet to sleep when they fell asleep when they were outside and the other children were playing outside on the deck. R430-90-19(13) — strangulation hazards

The provider was out of compliance with this rule by having strangulation hazards accessible to children. In the outdoor play area, there was a stationary play equipment slide that had a screw protruding longer than two threads. This was a repeat noncompliance. Inspection: Unannounced, Annual Inspection.
