The provider was out of compliance with rule R381-100-11(1)(c) by not ensuring that each caregiver maintains active supervision of each child by knowing the number of children in their care at any time. In Toddler A Room, the caregiver stated they had 6 children in care when there were 7 children in the room. Inspection: Unannounced, Annual Inspection. Civil money penalty: $200. Correction status: Correction Verified. Correction action: On May 4, 2026, the licensor verified the caregiver knew the total number of children in care in their group as stated in rule.

R381-100-23(5) — Diapering surface smooth, waterproof, good repair

The provider was out of compliance with R381-100-23(5) by not ensuring the diapering surface is smooth, waterproof, and in good repair. In the Toddler A Room, the diapering surface had a cut in the material making it not waterproof or in good repair. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On 04/22/2025, the licensor verified the director designee had staff use a diapering surface that was smooth, waterproof, and in good repair as stated in rule.

R381-100-6(3) — No conduct adverse to children allowed

The provider was out of compliance with this rule by having a caregiver, and an assistant director, who did not protect children from conduct that endangered the children in care. In the facility, a child was forcibly restrained to their cot, by their caregiver, when they did not want to take a nap. The assistant director, when they were told of the incident, did not remove the caregiver from the classroom and left the caregiver with the children after they had knowledge of an inappropriate interaction between a caregiver and a child in care. Inspection: Complaint, Investigation Inspection. Correction status: Manager approval, no follow up needed. Correction action: On 02/12/2025, the investigator verified that the director will ensure all staff do not conduct themselves in a manner that will endanger children in care as stated in rule.

R381-100-12(5)(a)-(f) — Interactions with children

The provider was out of compliance with this rule by having a caregiver who had an inappropriate interaction with a child. In the facility, a child was forcibly restrained to their cot when they did not want to take a nap. Inspection: Complaint, Investigation Inspection. Correction status: Manager approval, no follow up needed. Correction action: On 02/12/2025, the investigator verified that the director will ensure caregiver's interactions with children do not include binding, tying, or any other form of restraint as stated in rule.
